    hi everybody, I am new with leagalbeagles and I believe I have a very interesting case in my hands.
    basically I just found out that Lloyds been misleading me, lying to me and pushed me into a loan agreement I have not supposed to have in a first place.
    when I started to bank with lloyds I opened a silver account as I have been told there are only 3options to open an account (silver, gold and platinum) last week I found out there is an option of a current account, but because they have not told me this information before, I have been charged 8£/month for having the card even known I have not used 1benefit out of the card -made me go overdrawn several times.

    when I have tried to changed my account into student account they canceled my application as I have been overdrawn once in the previous 3month and because I have been in the country only 2years. they told me that if I have got money problems instead of a student account I should take a loan worth 5k. but I refused and walked away.

    when the bank realized I had student loan, bursary and even my salary coming into my account they sent me a letter offering the 5k instead of student account once again, but when I went in to ask about the loan I have been told I am not eligible for anything.

    In the last 5 months however LLoyds charged me over 1000£ for being overdrawn when the causes of going over my limit were the constantly growing overdraft charges.

    this lovely bank pressured me into taking a loan with them and they told me through the phone 'they will be no more charges added to this account' . now its November and because of the overdraft charges I am in debt again. basically they started charging me again which sent me overdrawn and I cannot pay the agreed amount including overdraft charges as I am still a student and work still only part time.

    on top of that I am going to be made redundant on the end of this month. I feel I have been robbed, mistreated, lied to and bullied into a corner where is no way out.

    I had a meeting with the branch manager but when I arrived the receptionist told me the manager is very sorry but he had to go somewhere and was unable to meet me, therefore I had to talk to a person from the reception.

    as I am extremely determined to get all my money back I will appreciate any help from you. also would like to teach lloyds a valuable lesson as I ve seen they are robbing everybody who is opening an account with them.

    Sounds like misselling to begin with of the packaged account since that idea of only mentioning the "packaged" accounts does not give you the option of a non fee paying account.

    Student account for home students are 3 years within the country. Are you formerly EU student, or Non EU with a visa?

    Was that simply marketing material or was this direct from the branch? I suspect a coincidence with regards to this possibly.

    How much have you been charged in the last few years with packaged account fees and are they the cause of the charges in the beginning?

    I'm not sure realistically that anyone on the site can get all your money back but we can certainly see about a few points, ie not offering a non fee paying account which MIGHT have been one issue.
    Why have you received charges, ie is it because of Direct Debits/Standing Orders or card payments causing an overdraft?
    Is the charges causing you to be behind on your rent or utilities?

        yes I am an EU student and now in country for 4years and yes mainly I have been overdrawn do to charges. no Direct/debit and standing order or other payments - although happend once in April I have been overdrawn with £5 than they charged me a month later with£120. since than I was not able to bring my account up to speed.
        I have been offered the 5k loan by the branch at the first time than I received a marketing package a month later.
        I had to pay for the package £8.06 once during the 3years and £7.95 on monthly basis.

          What hasn't been merged was my response to your original thread so here we go again!

          If I were you, tomorrow I would go and open another bank account elsewhere and transfer any monies you may have into this.

          I would then complete an IE sheet and post it up here for us to look at (mine went from being well in credit to £139 O/D each month as I'd forgotten to include so many things.

          Once that is finalised I would send it with a letter asking Lloyds to freeze all charges and interest. See how they reply and take it from there.

            Caspar, hold on, I don't see any hardship. There are no standing orders or Direct debits so difficult to prove arrears unless all bills paid in cash and lower than expected. If the account is in arrears already then he should be ringing the bank since the branch is highly unlikely to be able to make any decisions and look at a payment plan, not a loan cos that may not be in his interests.

            To the OP, do you have priority debt arrears which is rent, utilities, etc,etc,?

              That is precisely why I suggested filling in an IE sheet and posting it here first. Any other action depends on what is in that. If he does an IE sheet your question would be answered. I'm always glad as you know to be corrected as I'm new to all this, but I'd have thought the IE sheet would have shown us a clearer picture than vague words, and opening another bank account would, in my opinion, not be a bad thing as he can make a "fresh start" with the new account while resolving issues with the old one. As I say I'm very grateful to be corrected, so could you tell me where I've erred in my thought processes here.

                thanks for comments. I already changed my account to Barqlays - I know it is not the best choice but here we are. my IE sheet is as follows:

                OUTGOINGS:
                Rent: £250
                Gas and Electricity £60
                Housekeeping £50
                TV license £10
                Traveling £10
                Phone and Mobile £45
                Maintainance £100
                Clothes £20
                £580

                Creditors:
                Lloyds TSB (loan) £40
                Barqlays credit cr £15
                Littlewoods £20
                HFC bank (Laptop) £23
                Car Insurance £67
                £165

                All together £580+£165= £745/ month (outgoings)

                INCOME: £755/ month

                I do not receive any more student loan as I have received the 9 payments from the SL company and will not receive bursary either as I am in the final semester of my studies.
                My income drastically decreased in the last 2 month as I am going through redeployment and I have lost out on overtime opportunities. I cannot take full time because it will be impossible to finish my studies (4month left). It also looks like, as the company I am working for was unable to find me a suitable job, will be made redundant on the end of this month.
                any more information needed please let me know.

                    I am going to ask that the thread be moved in the Hardship Issues forum. Personal opinion is that it isn't financial hardship but the charges MIGHT make it a close run thing.
