    Debt Star: I will be in the country probably in the next 6 years yes but to be honest with you I am not really bothered about my credit history as I feel I am done with credit cards, loans or anything else what can put me into hardship, I learned a lesson and I am not going to make the same mistake again. yes I know the consequences, but in this case the bank stole money from me so if there is any credit history for banks I want to write a review.
    I hope you feel better today. one of my old friend used to say this to me: if you feel bad in your life , you just show the life its winning against you, so dont give this pleasure to your life.

    Eryca's overdraft is comprised mainly of costs incurred through her being mis-sold an account in the first place, otherwise she wouldn't be in this position, so we're trying to get those charges written off. Also her IE sheet demonstrates extreme hardship.

    That's why I wouldn't suggest token payment at the moment, but definitely maintain contact informing them of her position / actions.

    By the way Eryca - that company wrote off my debt - nearly £2500!

    I think thats right, but you say there is an overdraft? The bank may cancel it at any point and if they do that they will ask for the amount back. If thats not paid they default you. I'm not sure how important your credit score is to you right now or if you will be in the UK for the next 6 years and need credit here, but if you will be you might want to avoid falling victim to the "computer says no" mentality of your bank and try to pay something in towards clearing your o/d, even if you subsequently claim back the charges. Just my tuppence worth. I'm not doing too well today (!) and hopefully casper will put me to rights if I have any of that wrong!

    I got a letter from Lloyds tsb again today that I am overdrawn and I supposed to pay £162 - my account went into red because of them in September I do not intend to pay these charges just wait until they respond to the letter.

    To be fair to them, I suggested you contact them if you had problems removing the attachment, not to help with the thread.

    It will be very interesting to see what the reply is. I'll tell you now I sent a similar letter to a car finance company a few weeks ago. They responded by sending me a notice of arrears and I've re-responded (is that a word?) saying I was very surprised to receive this letter before they'd even acknowledged my first one. As I suffer from mental health issues, I also pointed out (again) the MALG guidance and stated I felt this arrears notice was going against those guidelines and adding unnecessary stress and anxiety.

    I am still waiting for a reply from them and their solicitors to whom it was copied.

    How about something along these lines? Would very much welcome anybody else's input also:

    Dear Sir/Mr

    Ref: Your Account Number: xxxxxxxxxxxxxxxxxxxxxxxxxx

    I wish to inform you of a recent change to my circumstances which mean my already poor financial position is about to be exacerbated as I am about to be made redundant. I am writing to inform you of this at the earliest opportunity in the hope that you will be able to do all you can to help.

    Please find enclosed an updated Income and Expenditure sheet which details my present financial circumstances. As is apparent, my outgoings far outweigh my income and as such I am experiencing extreme financial hardship. This situation will obviously get worse once I am unemployed and I do not want to abandon my financial responsibilities.

    You will know from your records that I feel I was missold the account in the first place, as I was not informed there was a current account that did not incur monthly payments. In light of this, I would be grateful if you would consider writing the remaining balance off, particularly as the majority of it is comprised of your own charges on an account I believe I should never have had. This would clearly help my current position.

    I would like to assure you that it was never my intention to renege on my financial responsibilities, but unfortunately my current circumstances are such that realistically I have no option.


    I would also be grateful if any further charges and interest could be stopped in order that I can do my best to get out of my predicament.


    I would greatly appreciate any help you can give me and look forward to your comments on this matter. Should my circumstances improve I will, of course, let you know immediately.

    well thank you for all the help,I have done all those things you told me to do and I will definitely send them the letter as I just got a letter saying I am overdrawn 80£ already.
    to be honest my boyfriend is more determined then I am because he wants to bring the whole bank down, I just want to break free nothing more and clear my credit record and I think am done with credit cards.

    so I should use the letter what says I am in hardship and need to freeze my account? or which one did you meant?

    Hi Again,

    Hopefully you've removed personal details now. If you have problems pm Amethyst, Sapphire, Amy or Curlyben and I think they could do it for you if you give the thread reference.

    The only thing I can see now is the pet expenditure. Pets are not an essential. Can you lose that £40.00 somewhere else (add a bit here and there to other items) then remove the pet expenditure.

    Once you've done that as Amethyst posted, it's a case of writing to the bank with a copy of this explaining your circumstances (and that they're about to become worse). In your situation with no disposable income I'd ask them to write the debt off and see what they say. I did a letter previously for you which was personalised already to some extent. If you take that and personalise it more it should suffice I would think. Then all you can do is not worry and await their response.
