    How did they debit the account? was it via debit card or Direct Debit?

    If Amazon have already refunded you, I would write to them enclosing a copy of the relevant bank statements and requesting they refund the bank charge as well. You should be able to tweak the original one of mine slightly to suit stressing how it caused you bank charges etc.... which would not otherwise have been incurred.

    I will do so as there was never any subscription and what gives a right to company to get into my bank account and subscribe me to 'amazon prime'. what legal rights they have got to do this?when I called amazon regarding the matter they did refund me but it was too late as my account went overdrawn already.what can we do to make people aware of this as I believe this is disgusting.

    With regards to Lloyds I would suggest the following:

    Dear Sir/Mr

    Ref: Your Account Number: xxxxxxxxxxxxxxxxxxxxxxxxxx

    I wish to inform you of a recent change to my circumstances and as such I am unable to maintain the present level of repayments. [Add your explanation here, keep it brief and in one paragraph if possible].

    Please find enclosed an updated Income and Expenditure sheet which details my present financial circumstances. As is apparent, my outgoings far outweigh my income and as such I am experiencing extreme financial hardship.

    You will know from your records that I feel I was missold the account in the first place, as I was not informed there was a current account that did not incur monthly payments. In light of this, I would be grateful if you would consider writing the remaining balance off, particularly as the majority of it is comprised of your own charges on an account I believe I should never have had.

    I would like to assure you that it was never my intention to renege on my financial responsibilities, but unfortunately my current circumstances are such that realistically I cannot maintain payments of any kind.

    I would greatly appreciate any help you can give me and look forward to your comments on this matter.

    See how they respond to these letters, then take things from there. I'd like someone else to look at and comment on these letters first however before you send them. If you do send them, send them first class and ask for Proof of Postage.

    I think you need to decide - the two issues are intrinsically linked so it's hard to separate them, yet each needs dealing with individually.

    As regards Amazon they have charged you for "Amazon Prime" as far as I can work out. This is something you have to subscribe to so they should be able to prove you subscribed to it.

    If you're sure you didn't I'd send Amazon a letter along the following lines:

    Prove it letter:

    Name/Address:

    Date:

    Dear Sir/Madam

    In June of this year you withdrew £49.00 from my account which you claim was owed by myself.

    I would point out that I have no knowledge of any such debt being owed to Amazon.

    I am familiar with the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR 2008) and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.


    While I appreciate you are not pursuing me for debt, you have already taken money out of my account for a debt which I believe was never mine.

    I would ask that you provide evidence as to my liability for the monies in question.

    In the absence of any such evidence, I look forward to receiving a full refund of the monies involved in this transaction plus the resulting bank charges resulting from it of £xxxxxxxxxxx, otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

    I look forward to your reply.

    could you define hardship please, because if I put more things on my IE sheet I will be over my monthly budget and I know food is low but I have a budget to live with. at the moment I am signed off by my GP with depression, but I am looking for a job at the moment as my new job did put me into depression. at the moment I am going for counseling once a week and soon as I get better and find a job will have some extra income.hopefully sooner than later.
    I also will get a lump of payment about £3000 which will be good for short term. also my landlord pays all the household repairs, I dont pay council tax as I am a student and my agreement with my landlord covers the water rates.

    So what are you saying? first thing is to deal with my account and then Amazon? I would like to know what is the case in here, how long it will take and what can I take out of this. my overall goal is to be able to be free from lloyds, and yes I think amazon has to pay because no one gave them permission to access my account but they did anyway. if they can do this to me no one knows how many people suffered the same.

    Re your I/E sheet:
    1. Do you really pay no council tax?
    2. Do you really pay no water rates or bills?
    3.Your food bill works out at £23.08 per week - this seems low.
    4. Do you really have no household repairs (light bulbs, replacing curtains, carpets etc.... over time)?

    I'd amend the above as necessary then repost (I think I ended up doing mine 4 times!!!!!!)

    When are you being made redundant? Will you get a lump sum pay off? Pension? If not, have you any idea what your income will be?

    This is weird as we both agree with each other lol! It's just HOW to go about it. I'd be inclined to sort the account first then deal with the Amazon deal. You would do both together.

    Both would gain the same end result, so guess it's up to OP to decide!

    We are looking at two issues intrinsically related:
    1) the cause of excessive charges which is Amazon
    2) the misselling of a packaged account with a fee attached.
    Yes an I&E form is needed but imho that may not get the OP very far apart from a payment plan to repay the amount owed including excessive charges and the misselling.

    I still think we're putting the cart before the horse here. Let's get a proper IE sheet done and looked at, deal with that, then deal with the "side issues" one at a time.

    I did have £500 overdraft limit what I was covered for but when they took out the silver account charges I went overdrawn because I did not have enough money on my account.
    i used to shop at amazon for books to university but never signed up for subscription. that day amazon turned around and charged me £49 for membership which I never agreed to. when I called them about the situation they just told me that if I dont want subscription I can cancel it - what I never even opened in the first place. basically they used my details to open a membership for me WITHOUT MY AUTHORIZATION and took the money out of my account which made me overdrawn once again.
