I understood it to read that because he thought the charges were not responsible for the debts, he couldn't claim under hardship status but I may wrong.
Either way the guidance in the original waiver direction suggests that the cause of the hardship is irrelevant.
Guidance: If the complaint relates also to other matters, including but not limited to disputed transactions, or financial hardship, this direction does not modify the firm's obligations to deal with the other matters in the usual way.
