    Morning Nem

    I have been in touch with Santander, they have a record of payment on the account but it wasn't made by a debit or credit card. And they have no details of who made the payment. It was definitely not me, as like I said before I wasn't in the country. I have also received a letter from the court and a letter off of Robinson way.

        Happy new year nem!!!

        Thanks for the quick response. The court letter is a acknowledgment of my defence and that the claimant may contact me to resolve the dispute directly. And they will inform me on what will happen. And it says where the claimant wishes to proceed they must contact the court within 28 days. Or the claim will be stayed?!?

          That fine the claimant has 28 Calendar Days to respond to your defence, as said If the claimant does not respond the court of its own volition stay the claim i.e. suspend it and the claimant will have to apply to the court to lift the say.

            Nem,

            I have not received any correspondence from the solicitors or Hoist. It is coming up to the 28 days that the court gave. Is there anything I should be doing? Do I need to send any more letters?

              Hello Ben, responding to your PM.If Hoist has not responded to your defence once the 28 days have passed, the court will stay (suspend) the claim. you will not
              be informed if this happens, so given the backlog in the court system give a couple of days over the 28 and phone the court to check the status of the claim.

                i was was going to ring them tomorrow that is 9 calendar days over. I received a letter from the court saying it was allocated to the small claims track. What shall I do now?

                            Hi,

                            From what I gather on the forum - you will need to fill out and return (send recorded post) the "directions questionnaire" and as for "The debt actually goes statute barred again in less than a month.. " unfortunately the 6 year clock restarted when they made the claim in the county court business centre.

                              Has the claimant informed you that they intend to continue the claim?

                              A debt must be Statute Barred on or before a claim is issued, the
                              6 year "clock" stops when a claim is issued.

                                Hi Nem

                                they are going to peruse the claim on the basis that there was a payment made in March 2010. The payment was not by me and I do not know or have a clue who has made it.. Like I said in previous posts on here, I wasn't in the country when this payment was made and have no payments on my statements for the amount they are saying, I can prove all the above.

                                My my worry is that I have to go to court and don't have a clue what I am doing!?!? I haven't received any of the paperwork from them and they haven't provided any proof of who has made this payment! I don't know where I stand

                                I have received the letters from the court but haven't received anything from the claimant.

                                i am due to go away again in the next 2 or 3 weeks and will not be back until May. Unless I can get out of it
