    Have you asked direct to them for the details of this phantom payment, how / by whom/ cash/ cheque etc.., and demand proof!

      thanks for for the reply, I have rang the lender and they have said that there is no details of who made the payment. The claimant has not given me anything at all. they have said they are going to forward all the paperwork that I have asked for on to me. But I am yet to receive anything in the post

            the he payment was for 5 pound from DCA!?! Just received all the paperwork from Cohen solicitors.

                  May be a good idea to refute the payment again stating where you were and slip in that your " employers" can confirm that.

                          Good evening,

                          First, thanks to Nem on here for solving a lot of problems that I was having with a CCJ from hoist portfolio. And secondly, can I claim expenses back from the claimant from the case that has now dragged on for the best part of 10 months. And caused no end of stress days off to write letters and running around try to meet dead lines from the courts and the claimants?

                              Has this claim reached a conclusion?

                              The court will usually make an Order for costs at the end of the day and/or along the way if there are endless hearings. Sometimes costs are rolled over until the final hearing.

                              The rule of thumb is that a LIP (Litigant in Person) can charge their (justifiable) time at £19 per hour if they 'win' (that may include a discontinuance after a defence has been filed). Expenses such as travel or loss of pay/income to attend court may also be considered.

                              Usually all these things are dealt with on the day (if there is a hearing/trial) but if there is an agreed settlement (including a Discontinuance) they may be dealt with later.

                              What stage in these legal proceedings have you reached?
