  • Received claim form Civil Enforce Limited

Hi, hope someone can help me?,

I have received a claim form from County Court Business Centre on behalf of the claimant Civil Enforcement Ltd. regarding a parking fine back on 04/02/2015.
At this time I had parked my vehicle in the McDonald's Car park on the felling bypass in Gatehead, as had a meeting with local companies and the manager of McDonald's itself.
I later received a parking fine through the post which I immediately disputed as it showed that I had only overstayed by 10 mins and that the meeting was held with local employers including McDonald's manager. From sending this letter I had not heard anything further until receiving this letter today. As you can imagine I thought that my letter of dispute had been accepted as had no further correspondence with them any further.
However, I have spoken to the small claims department at county court business centre and they have advised me that this is what the claim is regarding and that the claimant is claiming for the total of £227.06.
Do I have to pay this? To avoid ccj and further action on credit file. the advisor on the phone did explain that as Civil Enforcement Ltd have said they will provide me with separate detailed particulars within 14 days I should wait till this is received as will provide full information.

Can anyone help with this as am unsure if I should defend the claim or look to pay. Don't understand how it can be over a year and only receive further action now following my dispute letter.
Any help would be great., as you can imagine I don't want this to go anyfurther or to impact my credit.

    Thanks

The manager is the best port of call to get it cancelled.

Post up sanitised versions of what you have and

Get your own confirmation from SRA that Schwartz has no standing to sign the claim.

I suggest you contact the SRA.

    contactcentre@sra.org.uk

    Dear Sir/Madam,

I write to you to enquire about Mr Michael David Schwartz #118966 who was/is subject to control of practice as per http://www.sra.org.uk/consumers/soli...ticle?decision

It is my understanding that "Mr Schwartz shall act as a solicitor only in employment, the arrangements for which have been approved by the SRA."

As he is lodging claim forms with the courts, i would like to enquire if any arrangements are in place to allow him to do so ?

    Yours Sincerely

This has no effect on the court timescales and we must keep to those.

Re: Received claim form Civil Enforce Limited

Thanks, I have sent an email to the SRA as per your advice.

Unfortunately I do not have any further documents other than the court claim form received yesterday.
As i have only had one letter back in February last year and only kept this for upto 6 months as it was my understanding that they must have accepted my appeal letter which again was sent in February last year.
I am still awaiting details to be sent from the Civil Enforcement lets regarding the matter as the have specified that I should receive these within the next 14 days.
I have sent off the letter as advised to the SRA and will await further info.
If anyone know of any further action I can take in the mean time, please let me know. As you can probably tell I don't have a clue when it comes to legal action and can honestly say I have never been in this situation before.
      Thanks

Aside from contacting the manager, there isn't much to do until the particulars of claim arrive.
