There's a debt against my name with capital one for £1000 give or take. I've been getting letters for ages and ignored them. Late last year I replied to one of theirs something simular to asking for statements of account proof of the default and agreement etc within 14 days. A month later they send me a statement of account and a agreement with capital one that's been signed online. Nothing else that I asked for. I've ignored them all but today received a letter from Lowell solicitors threatening a ccj. Not sure what to do. Any advice?

Good afternoon, welcome to LB,

If you made a formal request for the agreement under section 78 of the Consumer Credit Act 1974 as amended accompanied by the £1.00 statutory fee you are entitled only to a copy of the agreement and an up to date current statement of the account. It seems that has been complied with. ( Were terms and conditions included in the response?)

When was this account opened?
When was it defaulted? If you don't know when the default was registered you can check your credit files with Noddle free Online.

It was opened 27.01.2012 and defaulted 24.08.2013

An old Lowell template adapted for use by the in house sols, as it refers to the " County Court Bulk Centre not the Business Centre.

Prior to this when Carters solicitors were dealing with Lowell claim the claim pack usually appeared in 48 hours. I take it nothing has appeared yet Carlos?

If possible can we see a copy of the agreement received please? I'm sure [MENTION=49370]Kati[/MENTION] will be able to assist again.

Any correspondence I've received from them I've binned which included the agreement they sent me from capital one. Is it possible kati you could upload the letter I emailed to you please? Nothing else arrived with the solicitors letter either no pack or anything just the Lowell letter :-/
