    Hi, Hope you are all well. My friend has had a Court Summons for non payment of water charges to United Utilities (the amount is disputed) they didn't send a letter before action and when my friend queried it they replied saying that they didn't have to issue/send letters before action! Please is that true??

    Yes, it is true.
    The Preaction protocols are not mandatory, but should be followed.
    The Courts take the view that litigation should be a last resort, and that claims should not be issuedprematurely when a settlement is still being actively explored. Parties are warned that if the protocol isnot followed then the Court must have regard to such conduct when determining costs,
