Hi, i'm in a bit of a pickle. I really don't understand any of this. I've received a claim form from Lowell from a debt that was supposed to be incurred from Vodafone. It was a mistake on Vodafones part and I do not actually owe the money but because all the correspondence was made via phone I have no proof. I have been sent this letter, what do I do from here please? Any help would be very much appreciated

Follow this guide: First Steps
Defence Deadline is: Wednesday 17th October 2018 4pm
The send a CPR 31.14 Request to the address on that form ask for:
1. "Agreement with Vodafone"
2. "Notice given to the defendant" of assignment
Send a Subject Access Request Letter to Vodafone asking for the same as in the CPR plus full history of the account. Vodafone Company Rep might be able to assist you also.

Hi, thanks for your reply. Basically it's my partners debt. He had a contract with Vodafone and when it came to an end he cancelled it. He took out a new contract with the carphone warehouse also with vodafone. He noticed that he was being billed for 2 contracts, so he rang them up and they said it was an error on their part and that they would cancel it and refund the monies taken. Well, this went on for a few months phone calls back and forth, still taking out money that they shouldn't have. They Eventually they said the matter was sorted and he would get a full refund but he didn't. Vodafone said they would cancel both contracts because he had been messed around so much and his account was zero. They never refunded him the money so he did a direct debit charge back to recover some of the money. He had a letter, he rang them back and was told to ignore it as the account was zero. He heard nothing for a few months then had a demand for £210, he ignored it again then it got passed to Lowell who now want to take him to court. He's not good at dealing with these things and would have paid up if the debt was his.
