  • New Forum User- MMF- Motor Mile Finance

    Hi All,

    I'm new here and wondered if i could have some advice.

    On Tuesday my mum text me to say she received an automated message from MMF and press 1 if it was the named person etc.

    I moved out from theirs 2 years 7 months ago, in this time no one has sent letters to my parents or to me about any debt. I called MMF and they took my mums number and details and said i have a debt with Wage Day Advance.

    I did have a debt with them but we paid that in 2010 (parents helped me clear some payday loans i had foolishly taken).

    I asked when the original agreement was from and they said 2011. I don't remember doing that, but i might have. If so fair enough, im not here to ask for help disputing it (asked them to send me the original agreement with WDA)

    My question is, how do i get them to agree to me paying a small amount per month towards this account? I can probably afford £10 per month at the moment as i am having to move house due to an issue with current private landlords.

    Do i write to them and offer this? What are my rights? I'm guessing they will try and make me pay more, which i can't.

    Any help appreciated

    If you didn't take out a loan in 2011 then you should not offer to pay them anything so I would really wait for them to send you the copy agreement. Also if you can check your bank account from that far back it may be an idea to do so.

    If your parents helped you pay off payday loans in 2010 would you really have gone and taken out another one in 2011 do you think ?

      Im pretty sure i would have learned my lesson. But they say they have the document etc so i might have. If i did i'm really annoyed at myself.

      Also heard nothing from WDA is it something they would normally do? leave it for 3 years and not chase it once? I literally have heard nothing. My mum would have said. She tells me everything, calls or post (there is no outstanding debts, but optical express like to get in touch often).

      I gave them my new address because my mum opens my post at her address (she has my full blessing on this). Is that an acceptance of debt?

        No, it's a 'here's my new address to send proof that I owe you some money' thing not an acceptance of the debt.

        Did they tell you the amount and date of the ''loan'' ? Did they give an idea when you would receive the copy paperwork ?

        Before making any offers you need to see the paperwork and evidence of the debt...then you can respond with your installment offer IF so required.

          Thanks, phew!

          They said it was March 2005 and they did say the amount, i can't remember what the amount was.

          He was really uninterested and i asked him to make sure the paperwork goes to my address not my mum's as she will worry, and he just sighed and said he would make sure. Better do!
          Never said when it would arrive.

          Should i just wait and see what transpires?

            If it has remained unpaid and unacknowledged since 2005, they should be informed that they can whistle for their money as the debt would have become time barred by section 5 of the Limitation Act 1980 (link) in 2011.

                If they drag heels getting the copy agreement to you you could consider sending them a formal request for a copy of the credit agreement under section 77 of the consumer credit act 1974 in the alleged loan (this gives them 12+2 days to comply else barrs enforcement until they do comply)

                  UPDATE:

                  Wage Day Advance have sent me a letter stating they have sold my account to motormile.

                  Any future correspondance should go through them.

                  Any idea what i should do now? Motor Mile haven't sent anything through the post yet. Im excited to see what crap they have.

                    Update: on friday MMF sent me a copy of my credit agreement, but its not signed obviously because it was signed online they say.

                    Surely it has to say my name on the signature strip somewhere or even say, signed online?

                      If you bank online I would go back through the statements and see what you can find. Failing that you could SAR the bank which will cost you £10 and get you everything, copy statements the lot.

                      You said in 2010 you repaid the PDL's with the help of your parents, you then said this was from 2011 or maybe 2010.

                      Did your parents make the payment or give you the money to pay. If they made the payments it may be worth asking them to check their records

                      If they paid it is possible that the money did not get paid off your loan and is sat in a suspense account somewhere

                        It seems that after checking our old records we paid wage day but this was taken out after it was paid, a year later.

                        Seems I must have despite not remembering. I have a few accounts so im not sure if i can check if it was paid in the loan.

                        What should i do now? Can only really offer about £10 per month to pay it.

                          When you say that you must have does that mean you have found the credit into your account or are you taking their word for it?

                          How much was the loan for and how much are they saying you now owe?

                            It says my credit limit was for £150.00 however i cant see a date on it and my signature is blank.

                            So i assume the debt would be for £150. They say i owe £189.10 now.

                            They havent chased this for years... surely WDA would have made contact?

                            And i haven't checked the statements, not sure where it would have gone into if i event took it out.

                            Actually scrap that... the date is signed by the creditor in 2009. Exact date 23/09/2009

                              It may be then, as this is from before you paid them all up in 2010, that one of the accounts ended up with a small balance still owing on it which has increased over the last 4 years to bring it to £189. Either that or if it was a seperate loan of £150 WDA are very reasonable with their charges.

                              If you do believe it is one that you took out you could ask them for a statement of the account and how the balance has accrued as you were pretty sure everything had been paid up in 2010 whilst negotiating a monthly installment arrangement. Also checking with them that the balance won't continue to increase.
