    Hi Jules in the same position as you. had that letter in october 2013 then 2 weeks later theta of doorstep collector, as of today have not heard from them since october 2013………. mine will be statue barred in feb 2014 Yours and mine must have been in the same batch sold.

        The exact same letter? The last letter before this was a letter offering 30% discount. Now they're going all legal speak, unfortunately I'm not SB until April 15. I've just checked my account and realised my last payment was in March 2008 as around that time I was trying get an IVA and was refused as all of my debt was with Lloyds TSB. How do I find out if the account is anywhere near Statute Barred? I'm thinking I may be nearer being SB than I thought.......

          Hi again, attached is my recon I hope you can read it. I've read it a few times but can't see any red to late payment fees of £12 however they have charged me these amounts several times........

            Yes same letter,and 1 before was the 30% discount. I am no expert but I think 6 years from your last payment or writen acknowlgement of the debt (but you must be sure)

                I don't have any annual statements, all I have is the copy statements they sent me up to the time they sold it to capquest in Feb 2009. Prior to that the last payment on the account was as per above but do remember sending Lloyds an income and expenditure at some point in the summer of 2008 in a futile attempt to get them to help me. So I don't really know when it will be SB.

                      Oh just thought, do I send the SAR to Lloyds or capquest. Do I also need to send a letter asking them what documents they intend to go to court with?

                        Whoever had the account when the alleged payment was made. Probably the bank.

                            Ok, so I sent Capquest an LBA bad protocol letter asking them exactly what they're intending to take me to court for and their latest response is a "Thank you for your complaint letter"! They have put the account on hold whilst they try and resolve my concerns and they will do this within 8 weeks.............. Surely if they had all their ducks in a row they would just go for the court option and stop stalling and naffing about?

                              Correct, but they never do so a response to their LBA was a good way to stop them , for now.

                              A subject access request to the original creditor might prove useful now you have time

                                soooooo an SAR is on it's way to Lloyds......in the interim I've received a letter from Capquest saying that they were following the lba protocol as they sent me some credit card statements (from 2007 until the default date) however they've gone on to say they will be requesting all of the relevant documents from Lloyds. Which has confused me somewhat as they have already sent me a recon CCA. I believe the original credit card was actually taken out with the TSB before they merged with Lloyds (it was taken out in 1993) so why would Lloyds have all of the original docs anyway?
