    The letter itself may just be a Notice of Assignment indicating the debt has been sold to Lowell. File it safely.

    No, *if* this went to court, it would be allocated to the small claims track due to the amount and there would normally be no costs awarded against you on small claims. There are exceptions, of course, but not likely to apply to this case. Before going as far as costs, if they decided to take this to court they'd issue a claim and you'd have the opportunity to defend or settle before it goes to court.

    Cel :yo: here is a consumer credit specialist and she would be able to assist if Lowell did something silly. Lowell are known for issuing Statutory Demands but Cel :first: is even better known for beating them every time they do! :whoo:

      Thanks for all the help on here. I haven't had any letters since but they have emailed me. I don't know where they got my email from, I didn't give this to the bank.

      I haven't found the document i received yet but I can remember it being a bad photo copy and I couldn't make out the interest rates. I read somewhere that they keep credit agreements on microfiche? When I said the bank had sent an application form, I remember it was actually their current terms and conditions not a credit agreement. Sorry trying to remember back 5 years.

      I expect I will receive a letter from them pretty soon.

        Discount Letter from red debt and Default from Lowel. :tinysmile_hmm_t2:

        I'm getting letters every fortnight now without fail, the latest ones are from red debt offering a generous discount then at the same time threatening me by saying they are passing my file over to their solicitors Hamton and are (not may be) recommending a method of collection? Why are they offering a discount?

        Also lowel sent a letter saying that I have no other defaults on my credit report other than from them. What happened to the original default? I didn't know they could add defaults on my credit file?

        I've read they send statutory demands out, i'm not sure how I'd respond. I'm worrying were this may be leading, are these standard letter? I'd be grateful for any opinion here. Many thanks.

            Do you get ones from their solicitor? My heart pounds with anxiety and worry when I open them, some are like statements as if I have an account with them and some are very threatening as expected. From what I've read they do follow things through though.

                          have you managed to find this document yet??

                          Was that the only document you got in response to your s.78. You mentioned a 'big application form' earlier?

                            WHAT? Are Lowell issuing default notices now? Or are you referring to a default on your credit file, as opposed to a default notice, i.e. a letter stating their intention to file a default. :noidea: :confused2:

                            That's usually a sign that they know they haven't got a leg to stand on. :grin:

                            They can update your file to reflect the fact that they own the debt, what they can't do is add a fresh default. The main thing here is the dates, because defaults drop off 6 years after they were first recorded.

                            They do send them, by the dozen, but then you'd get Celestine the Lowlife Squasher, on the case.

                                Hi, thanks for all the replies above. sorry for leaving it late. Just to sum up, the recent letters I've received were one offering a third off the alleged debt, one saying "repair your credit history, your Lowell account is the only default on you credit file" and another threatening one saying they are passing my details to Hamptons and asking me to call them or the consequences could/may be either, a door visit, a ccj or a statutory demand.

                                I found the original document and have inserted it above. I have scanned it using full contrast. Can you read it? The illegible parts are all the interest rates, most of the bottom section including the declaration. I've greyed out personal details.
