    Re: Mackenzie Hall/Colemans Solicitors

^ Thanks. Going back to page one of this I sent a CCA and SAR to HBOS in 2008 and they have never provided any agreement. I've no idea if I was sent a DN as it would have been sent more than 10 years ago, and as I mentioned above it wasn't with the SAR information they sent.

They often argue they do not keep copies of DNs, even more so given how long ago this was defaulted.

If they didn't provide it in 2008 it was probably because they couldn't find it, so what are the chances of them finding it now? If this was defaulted 10 years ago, probably close to nil!

Hard to tell for sure without a crystal ball but I'd say if no action has been taken in all these years...

Without a CCA, they wouldn't get anywhere, however, some creditors may still try and issue papers in the hope of obtaining default judgment. :rant:But should this ever happen, you'd have a solid defence as they've never complied with your s.78 request. I'd say probably best to let sleeping dogs lie and all that for now but if you get contacted by shysters again, a fresh CCA request may be in order.

^ Thanks for your response. I agree, no-one has a crystal ball so I'll just have let it lie and see what happens. Although if anyone has been at the LBA stage with MH I'd be interested to hear.

They've started calls to my mobile again. They appear to do this between letters.

All went quiet for a while, then I started getting calls/messages from the Portfolio Group (?) Now I get calls from (what they believe is) a local dialling code, but no message.
Is this a new tactic from MH?

I have had two from a apparent local number from MH.
Apparenly it is easy for them to do this.
I sent prove it letter, they have not, so far.

Have you got an Android smart phone? If you have, you can do a search for 'ignore call' on Playstore on Google and download a free app, you can assign calls to a blocked list AND text messages, you'll never get disturbed by them again.

Its fun adding their list of numbers to your ignore list, you have several options whether to divert them to answermachine or just hang up immediately on them. With text messages you can even send back a counter text message to numbers, or simply just choose to have their texts deleted so you never have to read them.

And if like me you find witheld calls irritating and rarely answer them, you can assign those calls to blocking as well.

Believe me, they give up long before your app will

using local area codes i.e. yourown is getting to be uysed by vanquis and a lot of others. so if you 1471 and your local area code but 4 or whatever cgances are it is not local at all.

As Ive said on many occasions the only time Muck Hall will see a Courtroom will be as Defendants. Think of DCAs as a pile of steaming dung. Muck Hall are buried underneath this

What I don't understand is if they're part of the same group as Lowells, why do they have such different policies on litigation?

Bit of a late reply, but I recently changed to a Galaxy S4 Mini, and this has a built in reject feature for both calls and texts. It's bliss not getting pestering calls from them. You can even record a customised voicemail for them if you'd prefer to leave a more personal response!

Well done! :clap2: It's still a good idea to log the calls and txts even if you don't answer them, provided the system you are using allows you to see who has called or sent txts. I don't use the Android platform so not sure about the technical details, but if it's possible, it's always a good idea to log them.
