  • cca request reply from a well known dca

    well i have had a dca send me a welcome letter. no worries as it became statute barred 10 years ago so i decided to have a bit of fun with them.

    sent the usual cca request BY EMAIL and put the alleged account into disagreement. i am hoping they reply as i have not acknowledged the agreement.

    i just asked them to prove the debt. pleading ignorance i asked for a copy of the agreement by email and the response is as follows

    be aware that the purpose of a request under the 1974 Act is to provide information to customers, not to establish whether or not there was a properly executed agreement in the first place or to be used as a tool to withhold payment

    thats interesting as i am familiar with the carey and godebt v critchley judgement and for the dca to put this to paper>>

    I would respond, by stating that they have a legal obligation to comply with your section 77/78 request, as failure to do so, would put them in default and as such render the alleged debt unenforceable, regardless of their reasoning or assumption that you will use it do not make payments, as reason for not complying. The debt is clearly disputed and you have not been provided of any proof the debt exists or proof that it is indeed my debt.

    Though to be fair you are suppose to pay £1 for a CCA request, and most actually send their request in writing with a £1 postal order.

        As he said, he knows its statuted barred, hes just having a bit of fun with them.

            Hi winner, yes i know you didn't mean anything, i myself am a bit confused as to why Militant would even waste his time communicating with them when a statuted barred letter would firmly put an end to the matter. But as he said hes just doing it for the fun of it, so whatever rocks his boat i suppose lol.

                If the alleged debt is really as antient as you believe it to be, it would not matter at all if you did acknowledge it. Once a debt has become statute barred, neither payment nor written acknowledgement can revive it.

                  thanks for the response people

                  i had my fill of various dca in my distant past and its now PAY BACK time

                  i am more enlightened now and i am doing it just to wind them up for the sake of it

                  i am pushing the not acknowledging bit as far as i can to see what comes of it, are they realy going to send me details when i have not confirmed i am the alleged account holder

                  they are desperate to get me to acknowledge the account so they can start the next stage of the threato grams

                  it is driving them nutts as the contact is only through email as i have moved address and have informed them i am of no fixed abode

                  anybody else out their do not do as i am doing, i know all the tricks of the trade that a dca will pull and relevant statute knowledge to back me up

                  it is me in the driving seat, not the dca

                    Please carry it through and keep us all inforned if im not caught with by my debts before they become SB i month after i shall contact these debt collecting threater and have my fun i have already had some phone fun in the past and you would be amazed at the threats i got wished i recorded them they really were funny but the BOYS never came round to sort me out even had letters saying they sent a doorstep collector round but i was not in,i was when i asked to speak to the collector for a desciption of my home which had a very distintive feature noone would faill to notice the call was ended strange that?

                        You should have asked them whether the "doorstep collector" considered that your doorstep was too commonplace to be at all collectible.

                            Hang on, they would be comitting theft if the doorstep belonged to part of a council house, housing association house, or privately rented house. Plus they have no power to levy on goods either as only a bailiff can do that lol.
