well i have had a dca send me a welcome letter. no worries as it became statute barred 10 years ago so i decided to have a bit of fun with them.
sent the usual cca request BY EMAIL and put the alleged account into disagreement. i am hoping they reply as i have not acknowledged the agreement.
i just asked them to prove the debt. pleading ignorance i asked for a copy of the agreement by email and the response is as follows
be aware that the purpose of a request under the 1974 Act is to provide information to customers, not to establish whether or not there was a properly executed agreement in the first place or to be used as a tool to withhold payment
thats interesting as i am familiar with the carey and godebt v critchley judgement and for the dca to put this to paper>>
