    please help i had 2 letters off Lowell, first with saying i owed them £611 which i ignored now on saturday after i i had sent them a recorded prove it letter the same day i recieved a statement of my account , the letter i had before the statement said that they were going to to arrange a home visit or take me to court

    Firstly calm down and please don't panic. They won't take you to court, they are very unlikely to arrange a home visit as you have to agree to an appointment, which you won't do, so in the unlikely event anyone did turn up, ask him to leave, andif he refuses, call the police.

    What is the debt for? How old is it? How much was the original debt? Are you at home by yourself? Are you female?

    There's loads we can do, they are bullies and threatening you to frighten you into paying up. They are very unlikely to have any more right to demand this money from you than I have - seriously!

    If you could answer the questions above, we can give you a good way forward. In the meantime, I would suggest you concentrate on answering our questions, forget about Lowells and wait until they contact you again - they will, but don't worry about it.

      i cant remember its been that long i think it was for a computer ? and the debt is from 2008 i am female im not at home by myself i have heard that you can sent them a letter of trespassing if they say they are coming to your home . i will wait to see what the next letter says because this statement of my account has got my name on it but there is no signature .

        OK, thanks. Don't worry, just wait for the next letter and then post up what is on it.

        You're right, there is a letter of trespass you can have by your door to hand them if you want:

        Dear Sir,


        Account No/Reference No: XXXXXXXX

        Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

        There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.).



        Please note therefore that I revoke this license under Common Law for you, or your representatives to visit me at my property. Should you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

          latest update off Lowell,
          we thankyou for your recent letter ,your comments have been noted but we advise you do not hold copies of the agreements within our offices and so cannot comment on the agreement.
          pleased be advised that we have requested a copy of your credit agreement in the accordance with section 78 (1)of the consumers credit act 1974 from shop direct.
          whilst we endeavor to reply to you with the required information within the prescribed 12 day period under the consumer credit act,you will appreciate this is dependent on upon receipt of the information from the original creditor. we will advise you further if it will take longer than the prescribed period .
          we hope that the above meets with your approval but if you have any queries please do not hesitate to contact us .

            If they phone or anything, make a note of the date and time of the call and simply refuse to go through security with them. Ask for everything in writing for the avoidance of doubt and then put the phone down.

              they have phoned me before i have answered the phoned but refused to talk to them on the phone sometimes they will phone twice a day

                Ask them to remove your number from their system and tell them very firmly that if they want to communicate it must only be in writing.

                  update on Lowell had another letter ,
                  we have requested a credit agreement thank you for contacting us about your credit agrement. we have asked your original lender for a copy .
                  we will as soon as we can we do our very best to send the information you ask for within the 12 working days , but this depend on when your original lender can send it. we will let you if we do not hear from them in time .
