Still waiting for them to send my credit agreement they requested nearly a year now

The reason Lowells has your debt is because there isn't a CCA. If there was, the bank would have had you in court by now.

Lowells are used to employ scare tactics hoping you don't know any better and that they can scare you into paying.

NEWS ON YOUR CREDIT AGREEMENT REQUEST
we have been in touch with shop direct about a copy of your credit agreement
they have let us know they are trying to retrieve the agreement from the archive .
as soon as we have it, we will send it to you.

WHAT WILL HAPPEN NEXT
in the event we cannot obtain a copy of the agreement we will write to you again and inform you of this.once you have seen your credit agreement , we will ask you to pay you outstanding balance in full.

Just sit back and ignore as its likely you will not recieve the agreement, if they make demands for payment again whilst no agreement has been produced we will hit them with a letter informing them they are in default of your CCA request, and as such the debt can not be enforced and their demands for payment are a breach of CPUTR in regards to being unfair and a breach of OFT Guidelines and may also be deemed a breach of the protection from harassment act.

Lowell have a Barclaycard account of mine too I pay them every month and guess what they have reviewed my account and tripled the payment
How can they review my account without asking if my circumstances have changed first in fact Im now worse off under the lovely coalition government but thats another gripe of mine

One very good reason why you should never sign up for a Direct Debit with a DCA. Cancel it immediatly. If you feel you really want to pay the scum then set up a standing order. That way YOU remain in CONTROL.

Ive had that with Liarells as well. They sent me an application form for an account which has never been behind in payments passing it off as one they have bought from the same bank. What complete shysters.

If its by direct debit and they are taking more than what you originally agreed to pay then they are doing so without your authorisation. When you agreed the repayments it actually forms a contract, they therefore cannot increase payments without your agreement to do so is theft and breach of contract by them. Personally i would stop the payments wait how ever many weeks the extra amounts would have covered ubder the original repayment plan, then start making payments again at the agreed amount via standing order.

Besides if they have no CCA go tell them to sit and swivel and stop all payments completely

i had another letter yesterday saying they are still searching the archive it looks like they will be sending me one of these letters a week saying they are still searching the archive has anyone else had this happen to the before and what happens in the end .
