  • Toothfairy Finance - Please help!

    I took out a loan with Toothfairy Finance back in September for £300.

    Unfortunately I was struck down soon after with what has since turned out to be Crohns disease and have since been unable to work at all. I was in hospital for days and have narrowly avoided having to have a colostomy bag after emergency surgery. To say its been hellish is putting it mildly.

    Unfortunately I haven't worked since, and as such all my debts have defaulted. I'm now with the CCCS and everyone is being paid a fair proportion of what I can afford, and everyone has accepted this except Toothfairy.

    Toothfairy have harassed me with up to 20 calls a day. I have had emails accusing me of fraudulently taking out the loan (I didn't) I have been screamed at down the phone and actually verbally abused by their loan sharks / Collection agents, and I have had dozens of identical letters from NDR fall through my letterbox daily. They are also repeatedly threatening to send out Bailiffs, even after I've told them I'm well aware that they aren't able to do so unless they win a CCJ against me. I'm a single parent on my own and even though I know logically they can't do this, it scares the crap out of me that they're threatening to.

    I am well aware that what they are doing is illegal. I'm now at the point where I'm telling them to take me to court. I borrowed £300 and they're trying to insist I have to pay back £1800. They've trashed my credit file (the least of my worries to be fair) so to be honest, I'd rather have a CCJ and know that the amount I have to repay is fair than give them a single penny. As it is the CCCS are giving them £5.16 a month and have been since November, so they can hardly have I haven't tried to repay what I owe.

    I'm looking for advice on how to report them, and how to get myself out of this mess. I was hospitalised last weekend because the anxiety of dealing with all these calls has left me incredibly anxious, suicidal and depressed. I can't change my phone numbers as my son is in school, so I have no choice but to listen to them calling hour after hour.

    I Don't deny that I owe them money, but the most I'm willing to pay is £4-500. Please can someone give me some suggestions of what to do and where to go to report them. They're refusing to compromise at all and the amount they say I owe is growing by the day.

    Hi Pepsi

    You borrowed £300 from Toothfairy - how much should you have paid back, if you had paid back the loan in full and on time? You should be aiming to pay no more than that.

    When did you inform them that you were sick and what was the balance at this point?

    Have you got a record of the harrassment you have received and the letters threatening bailiffs etc?

    How have they claim they have arrived at a £1800 balance for a £300 debt?

    They know very well that if they took things to court you are going to have them by the short and curlies. They have breached numerous OFT guidelines not to mention abuse of court process by threatening bailiffs, plus the dent growing by an extortionate amount.

    I would start with a complaint to the OFT and maybe even the FOS.

    You should also get in touch with Stella Creasy (MP) who is currently campaigning against these companies. I think she would be very interested in your story.

      Hello Pepsi,

      You have my sympathy with regards to your Crohn's. My mother has Ulcerative Colitis, which is related to Crohn's, and I have friends who have Crohn's.

      The first thing you must do is speak to the Equality and Human Rights Commission (EHRC) as you may be subject to certain protections under the Equality Act 2010, with regards to harassment and possible discrimination.

      As regards the behaviour of Toothfairy, don't even bother trying to reason with these bullies. Both they and NDR have gone well past the two occasions required under the Protection from Harassment Act 1997 to make their behaviour a criminal offence under Sections 2 and 7 of the Act. I am sure other LBs will add any other pieces of legislation that apply.

      Also, be aware that the senior management of Toothfairy and NDR are vicariously liable for the actions of their employees and Toothfairy can be held liable for the actions of NDR, as Section 7, Protection from Harassment Act 1997 makes it an offence to "aid, abet, counsel or procure another or others to engage in a course of conduct amounting to harassment."

      When you go onto the OFT's website, download an up to date copy of their Debt Collection Guidelines.


      In view of the effect this is having on your health, my best advice is to report this to the police and make them aware of not only what you are being subjected to, but of your circumstances, your health, including admissions to hospital as a result of Toothfairy and NDR's actions, and the fact you are a single-parent family. I would also report this matter to the OFT's Consumer Credit Licensing Department, your local Trading Standards Department and the Ministry of Justice.

      In addition to the law enforcement agencies I have mentioned, mention what you are going through to your GP and hospital consultant. If they feel this is having an adverse effect on your health, they may be able to lend weight to any reports you make to law enforcement agencies.

      Come back onto this thread and let us know how you get on.

        Nothing to add to the excellent advice offered above except to say, yes you can change your phone number. Are we talking landline or mobile. If it's a landline call your telephone provider and report that yu are receiving numerous threatening calls and that you would like your number changed and made ex directory; this should not be a problem. If it's a mobile do the same, contact your provider and report the abuse. Try for a new number or at worst, change the sim card. DO NOT GIVE OUT YOUR NEW NUMBER TO ANY DCA!!

        Now that the CCCS is administering your debt ALL creditors must deal with them, this is not optional.

          Thank you for all your replies. Just wanted to update 6 months on...

          Toothfairy are now getting £10 a month and so have been paid regularly for the 12 to 18 months (however long the debt has existed, I can't remember! lol!). They're still sending stupid texts and emails and calling daily. I just hang up on them when I hear the beep and get the "YOU REFUSE TO SPEAK TO US!" text shortly after. As far as I'm concerned I've said all I need to to them. I will wait until my CCCS payments hit £400 and then stop paying them anymore. I've complained to the OFT and got a response, but nothing much has happened, my complaint has just been noted. To be honest its become a part of day to day life now. I don't really lose any sleep over them anymore. I'm just waiting for the day my 'owed balance' hits half a mil, or a supposed bailiff turns up at my door, at which point I will call the police. Stupid company.

          One thing I will say however is I can't believe so much bad press has been given to Wonga, who acted amazingly in my personal opinion - they accepted my payment plan immediately after the CCCS contacted them, they cancelled all interest and even settled the debt early for 75% of what was owed (£100 reduced to £75) when I asked them to, and yet they have such a terrible name in the press. Toothfairy on the other hand have been treated identically by both the CCCS and I (I offered a settlement of £400 and they counter offered £3,500 - my current debt now stands at just over £4,000 according to them!) and yet they still bumble along breaking every rule in the book and no one has ever said a bad word against them in the newspapers or on watchdog or whatever. It's just ridiculous! They keep threatening to take me to court and I'm at the point where when I speak to them, I beg them to! What else will break this stalemate we appear to be at? Good thing I don't need a mortgage anytime soon, thats all I can say! :P

                  This is outrageous. You have been diagnosed with a life changing disease and they have used that 'opportunity' to mug you whilst you're on the floor.

                  Would you be prepared to talk to the media about this? Given yesterday's headline about the capping of PayDay loan rates, cases like yours need highlighting urgently.

                    (Sorry for the naked people at the bottom!) For what it's worth, I NEVER agreed to £72 payments and have never made them. They pulled that out of thin air. The balance seems to have randomly reduced too - now down to £3000 odd as you can see in the email. The left hand doesn't seem to know what the right is doing, as NDR tell me its over £4,000 all the time.

                    Now you mention it, most of my calls and texts are from NDR and MHB and have been for quite a while. It's only emails that toothfairy send now and as you can see they go straight to the junk folder and stay there!

                          Hi Cel, the media would have a field day with me - I'm a single mum with no family support around me, my friends all work full time so they only chance I get to see them is at weekends if I'm well enough, I actually reported myself to social services because all this was going on - I was so ill I felt there was no point going on and my child would be better off without me.. the works! In the last year my child has been diagnosed autistic, I've been awarded DLA because I'm so ill and I'm on ESA as I can no longer work. Am under the care of a psychiatrist who I was seeing weekly, and have medication reviews every 6 weeks. I now have 4 specialists I see on a regular basis. Pretty impressive, eh?!

                          To be honest though, I kind of see this whole situation as a massive wake up call. I've gone from being suicidal to the most happy I've been with my life in years. I'm dealing with things that I've bottled up for years with the psych, I'm not taking on too much anymore (I was a bit of a workaholic before) and I live day to day with what I have in my pocket - something I've never managed before. I'm hoping to go back into part time employment in the new year and both my child and I have seen the improvements it's made to our lives. My debts are reducing thanks to the CCCS and settlements I've been able to make, and this rogue company is just being ignored. I defy anyone to say I've not been responsible getting myself out of this mess, but its hard when you're dealing with people that are as unreasonable as toothfairy and their other names are.

                          I just feel for the people who are where I was six months ago. It's horrific to think they actually drove me to thinking I was such a bad mum that I reported myself to social services! What I wouldn't give to have 5 minutes in a room with the vermin that are the managing directors of this company. It's sickening what they do to people. And to think Wonga gets a bad name. Pssh. They were angels in comparison to toothfairy.
