Re: where do I stand with welcome

Received unsigned 'contract' from Welcome with no account number on it. Progressive Laons at the top naturally. I assume not worth the paper printed on, will request complete SAR but won't hold my breath.

Anything you can share to help the rest of us Labman? You helped enormously with Close Motors and you did say it was best to keep things on the forum.

Ahh well, maybe by the time mid 2008 came along they had sorted some of their paperwork out. Got a signed agreement from them! A photocopy of the front page of the agreement came through the post with our signatures on it........

Incasso have had the cheek to write again to say they have not heard from us!

Re: where do I stand with welcome

I sent an S.D.A.R. request. I didn't take this loan out, Mr Shads did but they won't deal with me. He was ahead with payments so wrote and said he'd take a four week break due to hardship. The phone calls started and carried on every day sometimes twice, we asked three times for the guy to deal with me, he refused, we said please could they write to us as we had already sent them a letter explaining the situation but he said 'we don't do things like that', he sent countless letters from local branch , we continued to deal with head office. Local branch got really nasty and said they'd come round, we told the police who said they'd attend if they did and make sure they left our property.

I have put in 2 formal telephone complaints, the second with a copy to OFCOM and OFT and have now started copying OFT and Trading Standards on every single letter I send and get back.

I have told them again Mr Shads signed nothing from a company called Progressive Loans, we told the Land Registry this and that we will eventually enlist the help of our local MP to get this company off the Deeds.

Some skulduggery has gone on with some directors being suspended and an £850 million black hole in the accounts. All in all, a bit of a mess and Mr Shads wants his information now because they have failed to deal with him in a reasonable manner. They started chasing him when he was still ahead in payments and not once have we dealt with head office on the phone, always the regional office. I'm confused and there are too many question marks over this company.

I have now gone to local citizens advice and he is also looking into this may have to pay to see the entry at the Land Registry but when we were moving ere the house had not been registered with them as the previous owner had built it for his own use and owned it outright.
The plot is certainly thickens its now a year since Welcome ceased lending and trying to collect what they can.

Re: where do I stand with welcome

There are probably people out there who need to get a job instead of expecting people to finance their wage. But that's just my opinion. I hypothetically don't want to be paying for a hypothetical someone to be playing a round of hypothetical golf and hypothetically dining out on hypothetical loan repayments not going where they were meant to go.

I'm not saying in any way shape or form that happens but what a plot it would be.

Re: where do I stand with welcome

I have looked through the posts in this thread. If a finance company has put its name on the deeds to any land or property without proper or lawful authority, that may amount to an offence under Section 2(2)(c), Forgery Act 1913, in which case, it is a police matter. And as the offence carries a maximum penalty of 14 years' imprisonment, it's an arrestable offence under Section 24A, Police and Criminal Evidence Act 1984.

Re: where do I stand with welcome

Thanks so much for the last post, you can't have any idea how better it made me feel.

Took the phone call today for Mr S, I said who's calling, he gave name but when I said what company he said he can't discuss that. I new it was Welcome and explained that Mr is dealing with head office and that he should liaise with them. He was getting increasingly angry and when I said he was being obstructive as he had refused to deal with a third party he was fuming and put the phone down.

I feel no embarrassment in saying I feel genuine concern over what their actions will be toward me, they seem very desperate. Mr S has been depressed in the past and I do not want him going to that place again, so he has exercised his right to a third party which this guy refuses.

I have already reported a previous threatening phone call and I want to get the police involved in the deeds issue now because I feel vulnerable if Mr goes out. I know I may be being a little dramatic but I could hear how angry he was by his tone.

Should I go to the same local police or to the fraud squad about the deeds issue, I will tell them about my concerns regarding these phone calls too.

                          Hi Shadowcat,

I hope I've read your post correctly.

Do you know if the Insolvency Service and the Office of the Official Receiver are involved in this matter? If so, they will be investigating this firm's activities with a microscope. When you say that directors have been suspended, do you mean disqualified? A £850m black hole in a company's accounts is a serious matter. If the firm is under investigation by the Insolvency Service and Office of the Official Receiver, I'd give them a bell first as you may have information of use to them in their investigations.

Welcome seem to be another above the law company but I will inform the above tomorrow, I have little faith in this lot being dealt with right now, they're breaking so many rules. I do copy in OFT and Trading Standards on letters but like I said, they're getting nasty with me in particular as Mr S has asked me to be third party and they refuse.

I think the authorities must know about the black hole?

                            http://www.debt-line.net/Welcome-Financial-Service

Mr S wants to know what the heck is going on with the money he's paying them.

                              Hi again Shadowcat,

Do you have a copy of the deeds from the Land Registry yet? If so, you will need to check to see if this company had lawful authority to put their name on the deeds. If they didn't, not only could it be Forgery, it may also be Fraud or Attempted Fraud as well. Whatever it is, someone is going to be up to their eyeballs in the brown and smelly stuff, sooner or later

As for reporting the matter to the police, all reports of crime are routed through a police force's 999 control room, their non-urgent telephone line or in person at a police station. You can report crimes to individual police officers, but it is better to report it in person at a police station. In this case, reporting in person at a police station would be the most appropriate reporting method.

If this matter does turn out to be Forgery and/or Fraud, the matter will be passed up to the CID who will then refer this on to a specialist CID team to deal with or they may liaise with other law enforcement agencies who may have an interest in the case and already be investigating it.

You may well be asked to make a Statement of Complaint or provide a Statement of Witness, as appropriate.

Without knowing the full facts of the case, I can only give a general overview, but I hope it points you in the right direction.

                                Thanks.

They foolishly sent us a copy of the Title documents as a threat but this drew our attention to the charge being Progressive Loans. I have spoken to Land Registry and will be looking to get these removed. I assume I will have to go through court for this.
