Hi again,

just an update on the crapquest saga!

i'v just received a letter from the above saying a person called m butterworth has been apointed as my case supervisor and he and his team will be taking me through the litigation process!
he said my case maybe passed to there solicitors(hl leagal have already sent 2 letters out to me?) so.
he said he will not be demanding the money owed in full but will accept £1400 less that the alledged £4700!

Shall i file or request a prove it letter..

In all the years CRAPquest havent changed their threatomatics. Svereal years ago I had an identical letter and am still waiting them to commence their litagation. WTF makes them think you would need Mr Buttery to take you through litagation

True enough there ODC, but should they ignore the Prove It we'll open up on their compliance dept and watch them drop this like a hot and smelly one

We have all read the same crap from all the DCAs so don't worry you won't get any letters that we haven't seen before. DCAs are nothing if not predictable

Especially crapquest.

Also if they are offering a reduction then chances are its because they prefer not to goto court, which if its for a phone contract it never gets taken to court anyway. And if its for a loan or credit card, then its probably because they have no CCA that is enforceable.

Bottomline, ignore, and same for the HL legal letters, they are just templated letter that are purchased by them to send to you nothing more. Which means no solicitor has even seen the account.

I got a court letter through the door once but because I had followed all the advice on here I filled a defence saying that I had asked for the information in the right order and none of this had been forwarded to me after many times of asking so I could not confirm the debt the case got frown back at them and they dropped it and added in the letter to me that they will still be pursuing me for the debt but never herd from them again. So even if it does go to court make sure you have asked for all the paper work in the right order file a defence and you can still win with the great help on here!!!

Hi,

just got a letter through from lowell portfolio for a debt £300 from 10 years ago.
it was adressed to my wife but since we've married her surname has changed.
They checked her credit report in oct last year and sent the first letter to which i informed them that she dident live here!
But just the other day they have checked my report now??
Is it really worth them chasing a debt worth £300 and is probably statue barred?
what i dont understand is why Crapquest have not checked my report after sending 6 letters to me..

Report lowells to the ICO as they do not have your permission to process YOUR data, which is exactly what they did when they checked YOUR credit report.

They are obligated to send out post contractual statements as per the Consumer Credit Act 1974 [as amended 2006] The requirement to send out post contractual statements commenced: 30 October 2008!

Ask for a Certified Copy of the original agreement. If Crapquest or the Leeds Losers don't know what that is, don't tell them. They should know or can ask a legal professional to tell them. For your information, a Certified Copy is, effectively, a photocopy of the original document endorsed with a statement, either handwritten or stamped, signed and dated in ink. CCs are the best evidence that a debt is genuine. If Crapquest or Leeds Losers or the OC can't produce a CC, penny to a pound it's a try-on, in which case, their collective Gluteus Maximus is likely to come into contact with the toe of someone's Size 11 hobnail boot!

I would just ignore it. You will only encourage them by responding, no way they can enforce, nor do they have any real intension of so doig .
