Why not post up your first draft and then we'll chip in any improvements / changes we can think of.

            Hi there,

i'm new to te site and would like some info/advice on this company capquest please.
            some back ground to my circumstances;

me and my wife were in debt managment programme from sep 2003 till nov 2010 for debts from far back as 1998!
we maintained all our payments and the DMC kept all the creditors at bay for the whole time we were in it.
we never had any ccjs or have ever been filed for bankcrupcy.
most of our debts wer paid in full and some were partially settled but none of them are currently sat on our credit file as there so old!
so when we ceased contract with our DMC they said that the RBS account that was in my name had stopped accepting payments in may 2010?
anyway the DCM refunded us any overpayments.
we then decided that we wanted a mortgage and were worried about the outstanding amount to the RBS of £4000! (this is now 13 years old by the way)
so i called th rbs credit managenment services and they said we are not pursuing you for this debt anymore and it would just sit on my credit report!
its not on equifax, experian or call credit!
since then wevv bought a house had additional credit and our reports are green and do not intend to loose control ever again even though we were paying the old debts every month.
I have just received a 2nd letter informing me that they now own the debt!
i'm not worried at this stage but was curious to see what they can do to recover the debt (if they can)?
I am more than willing to go to court and fight my corner as i really belive i have a genuine dispute.

please any advice would be gratfull

            thanks...

              Re: Capquest

The thing with SB debts is that they are still debts, they just don't show on your credit file and cannot be enforced (as long as no CCJ is in place), but DCA's can, and will, continue to write to ask for the money. If you write back telling them it is SB, they should stop pursuing you. If they don't tell them their actions constitute harassment and you will pursue this if they contact you any further.

                Re: Capquest

RBS Credit Mismanagement Services are not the most straight-forward people with whom to deal - they may have ceased to accept payments because :
                1. the debt had actually been repaid in full, or
                2. the debt would have been repaid in full if the refund for mis-sold PPI were added to it, or
                3. they had simply assigned to (equitably or absolutely) to Crapquest

The default may not shew in your credit reports as it was some six years ago but, as your agent had been paying towards that debt as recently as 2010, it is probably not statute barred.

How much - if any - Payment Protection Insurance did you pay and how much - if any - have you claimed back from RBS?

                    Re: Capquest

                    Hi guys,

i received a very strange letter from the managing director of capquest today offering me a payment plan stating that it wasent a gimmick and nothing sinister??
They also said the have set up a special phone number just for me?
this is the same numer as there main one!
The letter also states that my account is now being processed for leagal action?
Is this true even though they still havent made any contact with me?
Iv also had ther calls barred from my house!
How much would they have bought our £4500 debt for?
Would it be beneficial to them to take me to the court for a debt that is 12 years old and that according to the original ceditor was closed and would not chase for it anymore..
The previous letter was from h l leagal.
surely if legal action was going to take place i would just receive letters from h l legal??

any advice from you wounderful peeps would be greatly apperciated.

                    cheers s.......

Whatever you do S611 do not phone them or write to them at this stage and if the debt is 12 years old and you have not made any contact in that time I would not have thought they have a leg to stand on.

                              YES

But the proceedings will be against them. I would not even waste the spittle on a stamp replying to these Cupid stunts
