Well having gone around the houses with Cap 1 for the last 2 years (lots of threads on here) Capquest are now contacting me with threats but they are only acting for CAP 1 they obviuosly did not read the new OFT guidlines on DCA printed last week it flouts all the rules
I did send them a prove it which they choose to ignore but have not sent them any letters since they state they have done all the checks prior to CCJ action is this there proof as they see it then

Their laughable "checks" mean nothing - just a few papers passed around the office in reality.

To be honest, you've sent them the prove it letter, until they write to you with something worth considering, you really have nothing to say to them.

What is the original debt for and how much? Has any of it been repaid? Do you repay a regular amount? Has nothing been paid?

A little more detail on the debt would be very helpful in terms of advising a way forward.

They are now number 4 on the list of DCA chasing this debt all at the same time got Credit solutions offering 50% discount too but Capquest demanding payment for the full amount and threatening court action so its all going in my large file for Cap 1

i go by the rule of no contact with any dca

all my past debts wer settled with the orihinal oc

has any dca ever lived up to there promis of a 50 % rebates or as usual, is it just a ploy to acknowledge the debt

Update
Well another letter stating they have had to terminate various telephone conversations with me because i refuse to answer security questions (I have not had any phone calls)due to the data protection act they will now have to pass me back to the collection department where the phone calls will commence before legal proceedings are commenced
I gather this is another load of old tosh all I did was send a prove it should I complain about been harassed or file away with all the others

Send them the telephone harassment letter below if they do contact you by phone and make it clear that their comments in the recent letter about you refusing to answer security questions is a down right lie since up until then no phone calls by them were made to you. Plus why on earth would you want to confirm your personal indentifiable information that could be used to commit fraud to a complete stranger over the phone. Plus you still have not responded to my Prove it letter sent to you on (enter date) so i remind you that the onus is on you to prove thaty i am the debtor that you seek until them i will not enter any form of communication with you and under section 10 of the date protection act 1998 you are to cease processing my data and remove any notes or records placed on my credit file until you are able to provide undeniable proof to me.

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

I have verbally requested that these stop, but I am still receiving calls.

I now require all further correspondence from your company to be made in writing only.

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.


Be advised that any further telephone calls from your company will be recorded and a Fee of £50.00 will be payable by you for each and every call that is received. Any invoices that are not paid within 30days will lead to the commencement of county court proceedings.

You can also quote the new OFT Guidance which states they should have regard for the time and manner through which you wish to be communicated (you're not allowed to say none!).

Apparently now they will classify me as a Wont Pay and will treat me accordingly. I am really scared
