Since becoming a member i have had the worse 4 mths ever..

I contacted the CCCS and have been working hard towards claiming back all my bank and credit cards charges, credit cards have been successful, having major problems with Abbey contacted FOS concerning Hardship appeal, have had one small payments which is only a drop in the ocean to what I am fighting for in the courts. I would dearly like to remove the stay as it is been on hold since well over 18mths, went to court Oct 07, Abbey put late stay in 7 days before the court hearing, the court give details that the hearing had to be held by 31st Oct 08.. the amount is for a massive £36500.00 in charges, i have had approx £6500.00 back in July 08 after complaining to FOS.
My current position has now left me unable to meet my debts,i have tried so hard to be responsible contacting my creditors and repaying my priory debts. I do not want to go down the IVA route and wish to repair and maintain my debts myself. I have tried so very hard to manage things privately I now feel exhausted and depressed by my position,
Is there any way legally i can remove this stay and push Abbey in settling, my local court has stated this can be done a charge of £75 to submitted an application.. I believe I will now qualify for hardship as my out goings are bigger than my income.
Any advise would be brillant,a tonic too...
