    My current position has now left me unable to meet my debts,i have tried so hard to be responsible contacting my creditors and repaying my priory debts. I do not want to go down the IVA route and wish to repair and maintain my debts myself. I have tried so very hard to manage things privately I now feel exhausted and depressed by my position,
    Is there any way legally i can remove this stay and push Abbey in settling, my local court has stated this can be done a charge of £75 to submitted an application.. I believe I will now qualify for hardship as my out goings are bigger than my income.

    Any advise would be brillant,a tonic too...

      Hi Dickie.

      Have you jumped through all of the hoops of sending off the letters to the Abbey asking for your money back, sending the LBA, etc and had your claim stayed at court stage? If this is the case and the court has said [Quote] my local court has stated this can be done a charge of £75 to submitted an application.. [Quote]
      Then I would advise you to firstly contact the Abbey with a copy of the letter from the court where it says you can claim on hardship grounds and see if Abbey respond. If they don't and if you can afford the £75 it has to be worth submitting the claim, as Abbey will end up paying you back the £75 as well as your claim.

        Would there be a template or draft letter, i have tried this method with Ronan Coyle, he just said they would block it when i spoke to him in Jan 09

          So you are already stayed? Have you updated your spreadsheet with up to date charges?


          You need to give examples of hardship, there is no template as each letter is specific to each case.

            Hi Dickie and welcome to Legal Beagles,

            Why did Ronan say why they would block your application!

            Of the money you received back through the FOS was this with compound interest! How much of your claim is actually charges! and if you could post up the FOS letter omitting your personal details so that we could see what was said.

            We have had some good sucesses with Abbey and providing you genuinely fall under the FSA waiver rules then this should not be a problem.

            Once you have completed the I&E, update your bank charges and interest spreadie. Gather all your evidences together.... any documents that prove your hardship i.e Mortgage or Rent arrears, if you have a reppsession order or any other court documents. Evidences of your SSP would also help.

            Once you have all this together please update us and we will help you further with a letter to suit your circumstances. we do not use templated letters as each claim is different.
