British Gas

After years paying British Gas for both gas and electric,* my wife decided to change to a hopefully cheaper provider. Well after many,* many conversations were were told were were due a refund... bonus you would think.* More like nightmare. They said they would send a cheque... they didn't, just another bill to say we now owned then money.* So back on the phone ( which cost a fortune)... Sorted we now owned them a few pound,* which I paid over phone.* The other week a letter from BG turns up.* "Here's the promised cheque" for the sum of 1***....... Right they must if made a error.* So into the* bank it went. Today another letter,* this time from a Dept collection agency saying pay it back or lookout,* well words to that effect. So what do QR do. Add I said the letter said.. the promised cheque. Please we don't know what to do

Write to British Gas and tell them to go whistle, they told you that you were due a refund and one turned up therefore you honestly believed the money to be yours. Instruct them to call off the debt collection agency or else you might consider a claim for harassment against them and remind them that an entity can be held to be harassing an individual as established in Ferguson v British Gas 2009.

If they start threatening court tell them to crack on, but you will rely on a defence of change of position as established in Lipkin Gorman v Karpnale Ltd 1991.
