    Back in April I received one of those 30 day reply letters regarding a catalogue debt and I replied asking for more information. They wrote back saying account was on hold while they provided the info and I hadn't heard from them until recently again. They enclosed notice of assignment, statements for duration of the account, true copy of my credit agreement (which i am not sure is really classed as a true copy as it is just a photocopy of terms and conditions and has small signature on behalf of the catalogue company and obviously nothing in my signature box). They go onto say they cannot provide a copy of the Default Notice as they claim it was sent direct to me but they have enclosed a sheet shot of their system showing when the default notice was sent.

    My question is can a screenshot of someone's system represent proof of a Default Notice?

    They say they intend to rely on all this documentation in support of their claim if we go to court.

    Any advice by someone more knowledgeable in this field will be great. Can put up pics of this letter and attachments if needed.

    it will surfice as many have found out - just a record of one sent, but the question is faulty or not?

      vague infomation you have stated when taken out and give more details, CCA on line or not / when etc etc last payment etc etc

          Not sure what you mean by CCA online but it was a catalogue credit account that i took out online in 2015 if that is what you are asking. I was able to meet all payments for the first 18 months then I started to struggle in late 2016 and finally couldn't make payments at all in from early 2017.

          Tried to upload but it saying pic dimensions too big.

                They will pass using the online indication of a default notice having been sent and providing a 'example' default notice. As it was 2015 and an online application/agreement that should really have been produced, what they have provided doesn't seem to be the online agreement or full terms and conditions so you could ask them to produce further information - this is unlikely to have been the actual agreement you signed - it looks like one that they'd send with an order and ask you to return.... also the statement of account isn't very helpful as it doesn't start until 2016 and doesn't show any spending on the account, just the chasing after you'd ceased payments - so you could go back to them on that too. The 2016 entry is for a 3 month credit agreement - and that isn't mirrored in the document they have sent. It also doesn't state what catalogue it was anywhere I can see - JD Williams have a number of catalogues so it is strange there's no particulars stated. So if there is uncertainty on what this actually is I'd go back to them and ask for more details ( & possibly send a SAR to the original creditor )

                As it didn't default till Sept 2017 and was sold in Oct 2017 they have moved quite quickly. It is likely that they will eventually be able to provide the correct documents and to avoid dealing with court action and an increase in the amount owed, you are going to need to negotiate either a reduced amount full and final settlement ( as it's relatively recent I'd expect that would be near 70% ), or sort out an installment plan that is affordable for your circumstances. There is room with those documents to stall or negotiate harder for reduced settlement, but with these recent accounts, it would be quite unusual for them not to be able to comply through the court process.

                  Thanks for your input Amethyst. I am definitely of the mind like you that as it is a recent debt I will no doubt have to make payments. They did provide a longer statement of account but it was several pages so didn't upload that too. It does list items ordered and returned but no payment when i was actually making full payments. It just shows admin charges. Not very big ones just nominal interest you get on a monthly basis.

                  The table I uploaded was supposed to be a screenshot proving they had issued a default notice which i had asked them to provide a copy of but they say they couldn't. Although on that screenshot is says default letter. But think I am just going to have to accept that they will probably provide enough documentation if this goes to court and i dont want to risk a ccj at this point.
