  • Howard Cohen Letter of claim, sent CCA and NOA (I think!)

Hi, I need some advice if possible please

ii have received a "letter of claim" from Howard cohen, this was a debt from Barclaycard that was passes to MKDP then Robinson way

I requested the CCA and notice of assignment, they did send the CCA (it is not signed because I applied online.) It was sent to them from Barclays bank. Is also has a statement attached and I believe quite abit of interest for missed payments.

The notice of assignment was also sent but states the assignment from MKDP to HPH2. Does not mention Barclays anywhere. I had actually requested a deed aswell, but they did not send a deed.

I have no idea what to do now, have they sent the correct documents? Do I fight or pay up? Do they now have a winning case against me?

There needs to be a notice of assignment from Barclays to MKDP, then a further notice for them moving it on and it sounds like this is what they have provided. Also, there should be a default notice from Barclay card too.

Write back to them stating that you want copies of them both as if they are unable to provide a notice from Barclays to MKDP you'll be in a good position.

Good luck and post back once you get a letter back from them.
