    I would say that if they actually read what I sent, then they will realise that my letter was sent before theirs, but hey if I haven't heard anything about the other 2.9k by next thursday then they get an LBA, I am going for 14 days after I posted (allowing an extra day cos of the postie strike)

      you can ask them to take it back or accept it as part settlement Delta. They did that with me and then knocked ot off at the end.

        Ok folks I am in a quandry here.

        LBA for charges going out tomorrow, with CI it's just short of 3k at the moment.

        My limit on my card is £200, and I have a balance of £207, this down to them adding an overlimt charge after refunding this month's late payment charge.

        Anyway I sent them the CCA request at the beginning of the month, I also sent my SAR then, they have responded to the SAR but not the CCA, although a 'manager' has confirmed that my request is on the system, so they are now well over 12 days to supply that, and so far nothing.

        I have received this month's statement from them, so I am wondering what I am supposed to do about the statement and the fact that they haven't come up with the CCA yet? Do I pay the monthly amount, or do I just sit tight on this and is going to have a bearing on my claim for charges?

        Help????????????????????????????????????????????

          Delta I am stuck on this as your timing is in the middle, I do believe you can stop paying them and as your claim is well over what you owe them I would risk it sending them the letter account in dispute asap.

            Well, while I was out posting my LBA to Crap One, the nice postie has delivered a letter off them, ......

            Thank you for writing to us about the fees we've added to your account. I understand you'd like us to refund the fees we've charged, as you don't believe they reflect our costs. I'm sorry you feel we've treated you unfairly. (no **** sherlock!)

            To explain, we automatically add late payment fees if your payment is missed, arrives late or isn't enough to cover your minimum payment. We'll add overlimit fees if your balance goes over your agreed credit limit, which is £200.

            When we opened your account in June 2001, we sent you a credit card agreement which clearly explains these fees. By sigining and returning this to us, you agreed to the terms and conditions on the account, including the fees. (this will be the agreement that they have yet to send out to me then)

            As you're probaly aware the Office of Fair Trading has challenged the level of bank default fees. Although we feel £20 is a just fee, we've reduced our fees to £12 so that we're in line with our competitiors. I appreciate that you've incurred previous charges at the higher rate, and would like to address this.

            There is a fee for going overlimit or making late payment on your account, as you are aware this is clearly stated in your Terms & Conditions.

            I've reviewed your account and, as a gesture of goodwill, I'd like to offer to reduce the fees we've charged to £12 each. This amount total £394. If you'd like to accept this offer, please sign and return the settlement form I've included. Once I get it back I'll add these refunds to your account.

            We've credited an additional £30 amount as an acknowledgement of interest you may have incurred.

            Blurb about not incurring any more fees, then the stinker!

            While you are disputing these fees, it is important that you maintain payments as your account consists of transactions that you have made (eh?) Failure to do this may result in negative information being recorded on your credit file, which may affect your ability to gain credit in the future.

            I hope I've explained things blah blah blah.

            What a crock of shiney and bright, yes I am disputing things, but until I get that CCA they don't get another penny out of me, I am now counting down the 30 days...does the 30 days start from the day they received or the 13th day after they received?

                Well they are about 48 hours before the deadline for the CCA runs out, then it's down to them being criminals lol, oh and my cc statement should have been paid by yesterday, so no doubt the phonecalls will start soon. And, I am filing at court for my money back this week.

                  Got another letter of Crap One this morning....

                  Dear Disgruntled Customer.

                  Thank you for taking the time to write to us abou the fees we've added to your account and I'm sorry that you did not receive the previous letter we sent to you (that came about an hour after I posted the LBA), I understand you think these fees are unlawful and I'm sorry you feel we've treated you unfairly.

                  Blah de blah de blah etc etc etc.

                  So the amount has not risen since the last 'go away and play nicely' letter, and they still want to put it on my card for me.

                  So since I started this (which put the account in dispute) and requested the CCA (which also put the account into dispute) this is the best they have offered. I still have not received the CCA (now well in excess of 12 + 30 days), and have received 2 statments, each with further charges and interest on.

                  Mmmm, time to file at court, and time to send them a strongly worded letter about the dispute, non compliance of the CCA request, continuance of statements/charges/interest. And time to copy in the relevant 'authorities' (who do I complain to about the CCA default and the fact they are still sending statements asking for money?)

                  Over to you guys...thoughts, people to contact, etc etc please

                    Hi Delta,
                    You complain to the FOS about the non compliance CCA, write to them and ask for the name of their Data Control Officer, tell them you are complaining to FOS, it is the actual person that you have to name if you go to court over non compliance.
                    Have you sent the letter about account is in dispute?

                      Yes they have been informed that the account is in dispute, and they have acknowledged that fact (although that was verbally on the phone!), but the cheeky beggers say in the letter that although I am disputing the fees etc, I still have to pay the required amounts each month.

                      I'm sick of this now, they couldn't abide by the 'do not call' letter (apparenlty that doesn't apply to collections)

                      I am going to send them another copy of the dispute letter, I will ask them for the name of the DCO and inform them that I am complaining, and I am going to reject their pathetic offer and tell them that I will be filing against them incourt this week.

                        Oh and Crap One set me a letter about the 6 quid arrears on my account, asking me to pay it.....oooopsadaisy, they shouldn't be doing that with an account in dispute......more ammo methinks!

                          Go for it Delta!!!

                          Looks like we're at the same stage - I filed my N1 on Friday. Just hoping they'll pay up now sooner rather than later. There's a case OTR where court date is tomorrow and they haven't coughed up yet - a bit scary if you ask me!

                            And another case where the judge has asked both parties to provide info to back up CI claim - oooeer, maybe I shouldn't have gone for CI. Oh well, its done now so can't go backwards - onwards and upwards I hope

                              I don't think you did wrong going for CI, it is up to the judge though as was said in the beginning. You will still get your 8% if not the CI.
                              My Monument one was not settled till the day before court, Happy actually went to court with A&L they never showed.
                              If the judge asks either of you for info to back up CI then you will get it on here I,m sure.
