Ok this is interesting.

On 29 June I sent a SAR and CCA to Crap one, they signed for it on the 3 July. On Friday 6 July I received the SAR stuff.

I have just had a call from them....

Hmmm... they are getting pretty close to the 12 day cut off for the CCA request, the only effect that is going to have on me is that I am going to stop paying anything towards it.

This could get interesting.

Thanks Simian, I have told them that I will not talk about the account on the phone, and they obviously cannot understand the words 'put it in writing' so what the heck, if they want to waste their money phoning me then so be it, I can bore them faster than they can bore me!

As a gesture of goodwill (cos I'm nice like that), i decided not to claim the debited interest.

Oh dear, according to my paperwork and the track it thing for the recorded delivery, Crap One are now upto the limit on the CCA, they took delivery of it on the 3/7, ooooh look it's been two weeks!:banana:

Does this mean that I don't have to pay them anymore?

Just checked the trace it for my nice letter asking for my millions back, according to the website it left the delivery office this morning (I only bloomin posted it last Wednesday.... obviously its difficult to get post into Nottingham).

Can't remember, does the 14 days I gave them start from delivery day or dispatch day? (Ie are they already 6 days into the 14 days)?

Well I don't for one minute think that they will send the CCA, so I'm not sending them any more money.

But I am sure that when asking for my money back then it is 14 calendar days from the date of the letter, best go do some reading up

Got a letter from Cap One at lunch time, dated 13 July, proudly telling me that as a gesture of goodwill they have refunded a charge to my account, and giving me all sorts of advice and hints on how to avoid charges in future.

So have checked my balance, and they have given me a whooping £12.00 back, whooopideedoo:banana:

Well it was a charge that wasn't included on the SAR information, so i would have asked for it anyway, but they didn't offer, just stuck it back on my card.

Just hope they don't think that this is the end of it and you've settled for 12 quid!! Might be worth clarifying it with them that you're still chasing XXXX amount Although surely they couldn't be that stupid - could they?
