Ok a small update, the nice postie in the van has just delivered a Special Deliver envelope to me, and it looks like Crap One have complied with the SAR, there's reams of information, gonna need to give it a real good read through. The first statement they have sent started on 8/7/01 so they have gone back a full 6 years. There's loads of notes, most noticable this one....

'refuse sec// sz told to communicate in writing// its harrassment// took my name sz if she gets another call will report it// clls are recorded// refused to listen to anything i say hup'

I assume the hup was the point at which I just put the phone down mid sentance! its that good that she logged it twice! the whole bit of transcript, lol

    heeee heeee

They are strange , but all the info is there and a lot less paper work to copy for your court bundle (not that you will get that far). In actual fact it is quite near to a full SAR except no CCA T&C's.
      Happy reckoning. Enaid

Yea no T&Cs and no CCA, and there are two screen shots on each page, someone has obviously spent a happy hour getting all my info (lol)

Checklist for what I can claim..... let me know a yay or nay for each
        1. cash advance fee (not sure on this one)
        2. PPI (would think this is a yes)
        3.Annual Fee again not sure
        4. Late Payment this will be a yes
        5. Over limit fee another yes

Now the confusing bit, for the first few months there are two lots of interest applied, then it goes to one lot,, then it goes back to two lots?
Can i claim that back anyway?

          no to cash advance fee
          no to Annual fee
          Late payment yes
          Over limit yes
I would keep your PPI seperate
The interest will be cash, when you use the hole in the wall
purchase int when you buy something
It does not give your Int rates on these copies so you are going to have to find out what they were not a problem I don't think. That is if you are doing CI.

Yes I would like to do it with CI, but am gonna need my hand holding for that one, cos I am very confuddled.

Gonna start highlighting the late payments and over limits.

Will hilight ppi in a dif colour!

Flippin eck, just totting up the late payment and over limit fees comes to a whopping £1126, without taking into account any interest or such like.

and the PPI comes to £76

And te cheeky wotsits are charging me twoo lots of interest and it has been years since I took money out via an atm, and since I last did I have cleared to total completely.

And in Jan 2005 they have charged me a £3.00 cash advance fee with no sign of any withdrawl!

Delta have you got any proper statements?
If you have look and see what it says on them, the only reason you would have 2 different int payments is because of the reasons above. I think if you read the back of your statement it will tell you somewhere that the payments you make will firstly come off your purchases and then finally off your cash. So you may never have actually paid anything off your cash part, I hope you can understand me, let me know if you can't before I go any furhter

Just dug my regular statement out.

I don't understand why they are charging me cahs withdrawl interest. At one point the card was fully paid up, in fact I had paid about £40 too much, and I paid up what I spent just after that so no interest was charged for a couple of months. And I certainly have not made any cash withdrawls since before that point. Cheeky buggers.

Anyway according to my most upto date statment,
                  cash withdrawl interest ....... 2.158%
                  purchase interest ...............2.158%

(in this month statment, purchase was £4.54 and cash £0.22

On my sons latest its 2.528% purchase int £3.65
                    cash int £9.95
They don't even have the same rate for everyone, his cash is higher because he is always getting cash on it and it's lethal, sick of telling him.

Anyway have you had a study of the CI, I can't really help you with that as I have never done it, I know though you take the highest Int figure and the lowest and get an average that gives you the rate you charge them. It should make a big difference to your claim and you must put that you are claiming this from the beginning. You can't claim the 8% either if the judge lets you have CI.

Yea am gonna have a study of the CI bit and see what happens, guess it will be 2.158 cos if I add them together and divide by two I get the same amount as what they are charging! lol, it's nice when they make it easy for you isnt it!

Gotta do some work now anyway cos have been getting emails asking all ops to log on, texting fingers at the ready!

OK Delta, looks like we're doing this one together, my prelims all ready to send, will post it Monday, fancy doing it at the same time so we can compare notes?

(I have used their latest interest rate on each account, I was tempted to use the 35.5% they just offered my 18 year old son a card on last week but resisted the temptation.

Let me know when you're ready!!!

Depends on which way you wanna go, you can't claim charges back, then claim you don't owe them anything coz you haven't had a CCA!!

I used this spreadsheet and it seems to work just fine:
