My question is how best to deal with Lowells who have purchased a credit card debt off HBOS back in July 2013 - had various demands for payment ( did not reply to any )
but now had a 7 day letter from Yuill & Kyle Glasgow solicitors stating they represent Lowell - The solicitors say I took out a credit agreement with HBOS which was
assigned to their client on 24/06/2013 of which I have difficulty paying & Lowells portfolio 1
Therefore Lowells served a defult notice on me & terminated the agreement in terms of CCA 1974 - on the 21/10/2013
Therefore Yuill have now been instructed to recover ballance due of £4000.....
I now have until around 19th Nov 2013 before Yuill ask Lowell do they wish to proceed to court. My trouble is on my credit file, anything up to when Lowells purchased the
debt in July has disappeared no record whatsoever also I should mention 1 month ago I had a letter from Hamtons Legal stating they would accept £50 per month if I
replied or even maybe give me a discount off the total £4060.
I live in Scotland have any of you guys out there any ideas on the best way to proceed - I get the feeling Yuill solicitors will go quickly to court
any suggestions or should I accept this or would it be best to negotiate with Lowells before court for either a lower full and final settlement or a payment plan ?
or should I like a number of debtors in a similar position ask for a CCA true copy but feel they Lowells just produce any old copy as this would be not challenged.
