  • Lowell purchased HBOS credit card debt

    Hi all

    My question is how best to deal with Lowells who have purchased a credit card debt off HBOS back in July 2013 - had various demands for payment ( did not reply to any )

    but now had a 7 day letter from Yuill & Kyle Glasgow solicitors stating they represent Lowell - The solicitors say I took out a credit agreement with HBOS which was

    assigned to their client on 24/06/2013 of which I have difficulty paying & Lowells portfolio 1

    Therefore Lowells served a defult notice on me & terminated the agreement in terms of CCA 1974 - on the 21/10/2013

    Therefore Yuill have now been instructed to recover ballance due of £4000.....

    I now have until around 19th Nov 2013 before Yuill ask Lowell do they wish to proceed to court. My trouble is on my credit file, anything up to when Lowells purchased the

    debt in July has disappeared no record whatsoever also I should mention 1 month ago I had a letter from Hamtons Legal stating they would accept £50 per month if I

    replied or even maybe give me a discount off the total £4060.

    I live in Scotland have any of you guys out there any ideas on the best way to proceed - I get the feeling Yuill solicitors will go quickly to court

    any suggestions or should I accept this or would it be best to negotiate with Lowells before court for either a lower full and final settlement or a payment plan ?

    or should I like a number of debtors in a similar position ask for a CCA true copy but feel they Lowells just produce any old copy as this would be not challenged.

    I think the CCA request to Lowell's would be the way forward, but someone more experienced will be along to offer advice soon I'm sure.

    I'm also in Scotland and Lowell have 2 of my HBOS debts also purchased in June!

    Meant to mention Yuil & Kyle also issued me a letter before action in March 2013 regarding a loan account which is owned by 1st Credit, once I pointed out the dispute I had with it they backed right down and I've never heard from them or 1st Credit since.

        Thanks for info Lynnyloo, can I ask what roughly was your dispute about ?

        Hi Border Collie - last payment was 18th July 2011 I know its not time barred this was I think when HBOS issued a default notice a few months later after this

        payment was made. then nothing until 2013 when HBOS passed it over to Lowells

          There were inaccuracies in the credit agreement they emailed me on behalf of 1st Credit.

            Yes Lynnyloo tonight will print off a request for a 'true copy' of my credit agreement issued by HBOS & take it from there. Did you find it best to only email Lowell & Yuill & Kyle ?

              Someone will be on later and give you more experienced advice. But if it were me I would request cca from Lowell but also send letter to Yuil & Kyle letting them know that you have done that. I did email them, as I was so angry when I got their letter, but I think it's best to send a letter so you have a paper trail.

                    I would suggest sending Lowell the CCA request and then writing to the Solicitors informing them of the fact you are awaiting their clients' response to your CCA request. They have 14 days to respond. Don't forget to send it recorded delivery and sign digitally using a computer font and not your real signature. :thumb:

                      post Yuill & Kyle a recorded letter informing them of my CCA request to Lowell which will be posted recorded later today - again thanks for your advice.

                        The reason for not sending the CCA request directly to the solicitors is that, they are not the creditor, they are just acting for the creditor. Lowell are the creditor and they'll have to obtain the documents from the original lender. Informing the solicitors that you have sent their clients a CCA request should do the trick. :thumb:

                            Anyone have an idea what's best when submitting the £1 postal order on a CCA request to Lowells, do I write on the back or is it best left blank do not wish for it to be taken as an admission of anything under legal terms.

                              I have always left mine blank. The CCA request has a paragraph that says the funds shouldn't be used for any other purpose. :thumb:
