        Re: Santander calls

        just had another call..
Santander DO NOT have to comply with the OFT apparently, it is an IMPORTANT BUSINESS CALL and there is no way it will be done by letter.

I am now going to have Hubby revoke the call he agreed to with Nicole and state that it must be letter only.

Just recieved an email from someone about this complaint. I think its the person I just spoke to, in which case why did he refuse to speak to me?
Just said if the person who has just rang me is the person who sent this email I have no wish to speak with them again.

              UPDATE:
Despite an email stating that my name is on the account, I still cannot be spoken to with regards to this matter.
Another recorded message and another person ringing today, bringing the total amount of calls this week to 11!
This is getting ridiculous where the CEOs office are being ignored.. and Yours Truly is getting incredibly pi$$ed off with this very fast.
The simple answer is for them to be take the money out of the right bank account.. absurdly simple and I refuse to make a one off payment as they have adequate information.

I am in the process of being put through to a specialist team.. this is unbelievably bad and the OFT systems are down so I cannot make another complaint.

                      Original email sent

                      WITH REGARD TO ACCOUNT xxxxxxxxxxxxxxxxxxxxxxxx

                      Dear Sir Or Madam

I am taking time out of my delivery schedule to send you this email expressing my utter disgust at the way in which my wife has just been spoken to buy an advisor.

Recently, we have changed our bank details to Halifax (new details are on my account as there is a Direct Debit waiting for you to claim) and you have declined to take a payment. I am a truck driver and therefore am unable to take telephone calls, hence the password of Mollydolly being on the account, if not this is yet another failiure on behalf of your advisors, there is also my authority to speak with my wife, Joanna (Jo) Rose about whatever nessacary.

Imagine my disgust at recieving a £12 late payment fee for you failing to request a payment, and on your advisor telling my wife that she is not on the account and the calls she is receiving, harrasing her for my contact details, are perfectly legal and "Will Continue" despite the OFT Guidelines stating that : The debt collector should NOT:

                      • contact you if you have asked them to speak to someone representing you

                      • visit you at inappropriate places such as your work, unless you have told them they

                      can

                      • harass you by calling you frequently or making threatening statements or gestures

                      • send you letters that do not clearly let you know who they are and why they are

                      contacting you

                      • pressure you into selling property or borrowing money in order to pay your debt

                      • pressure you into paying in full or in large instalments

                      • pressure you to increase your payments to more than you agreed to in your

                      repayment plan

                      • add collection charges to your debt, unless you agreed to this with the people you

borrowed the money from (any amount they charge you should be based on actual

costs caused by the collection of your debt)

                      • threaten to give the details of your debt to others unless they are allowed to by law

or tell you that they can take legal action when they actually cannot

                      • make you think that they are bailiffs. Debt collectors do not have the same legal

power as bailiffs and cannot force their way into your home or seize your

                      possessions.

http://www.oft.gov.uk/shared_oft/consumer_leaflets/credit/oft1299.pdf link provided for you later perusal.

Also the OFT states: A company may not disregard a debtors request for a contact form. (IE postal, email or telephone)

                      http://www.oft.gov.uk/shared_oft/consultations/OFT664Rev_Debt_collection_g1.pdf

i have informed you verbally, in writing and once with a formal complaint to the OFT that you MUST CONTACT ME ONLY BY WRITTEN FORM.

I HEREBY REMOVE, REVOKE AND FULLY REFUSE ALL IMPLIED PERMISSIONS TO CONTACT ME BY TELEPHONE, ALL CONTACT MUST NOW BE WRITTEN.

                      Yours

                      George Rose.

1550: another call, automated press 1 for this, 2 for that and 16 if you want me to go away.

all this as they havent taken payment themselves. does anyone know the legality of this when we have provided them with the information they need to take a payment they are just refusing point blank to do it??

                          Re: Santander calls

Why don't you send them a schedule of charges you will expect them to pay at, say, £10 per unsolicited phone call - and then invoice the buggers when the calls continue?

                            good thinking Batman!!

I fail to understand how difficult taking a payment can be? they have the DD details and refuse to take a payment, I feel like saying thats ok you obviously dont want paying, leave us alone now!

What is really getting to me is the CEOs office saying they have told the c/s and outbound that I can be spoken to, and those departments saying no.. you cant be the CEOs office are wrong?!?

If the silly Spaniards cannot process a direct debit, why not cancel it and set up a standing order instead?

wont accept a standing order, either card payments in which case they will constantly bug you for a DD, or a direct debit they refuse to collect on.

We tried the standing order route to have it refused by Santander and funds returned to the bank.. plus 3 weeks of collections calls for non payment!
