    Please remember that when all said & done had legal aid been available & not refused (primarily IMHO because the case handler at the LSC did not understand the arguments) the solicitor would have pursued this matter

    Consideration was given to a CFA but again as this is relatively new argument in law & yet to be fully understood the insurance provider was also not able to be convinced of it's merit,

    Furthermore I have no doubt that when the 1st person attempting to reclaim their penalty bank charges will have been told pretty much the same ie "don't bother your flogging a deed horse" & look what happened there
