        OK. Due to moving and work I did not attend the hearing to get the statutory demand set aside. The result is that my application was thrown out and GD solicitor fees have been added on to what I 'apparently' owe them more then doubling what I originally owed. I got a phone call from GD saying they would be making me bankrupt on 6/1/12 unless I pay up. BUT, I have now had a letter from their solicitor saying they are applying to have a charge put on my house.

        This to me says they are unwilling to make me bankrupt (and pay the fee). Instead they want to reclaim what I 'owe' them AND their solicitors costs from defending my apllication to set aside the statutory demand. My question is, why would they bother defending the statutory demand if they had no intention of making me bankrupt. Personally I would not mind this happening but to put a charge of my property (negative equity btw), for the original balance AND their solicitors fees for defending the set aside application is taking the p*ss. What do I do? Why did they defend it in the first place?

          I don't know what you do now. Hopefully somebody will come up with something for you.

          The obvious problem is here is that you had your chance, and you let it slip through your fingers. However genuine your reasons for this happening, all the court will see is the cold fact that you did not turn up to the set aside.

          As I said, I honestly hopes somebody comes up with something for you, but I can't think of anything obvious. :beagle:

            Taking into account I know little about bankruptcy and statutory demands...

            How was a solicitor for the claimant able to order you to pay his costs? You dont have a contract with that solicitor. In any event, your OP indicates your landlord was dishonest in the sale of the freezer.

            You need to speak to an expert on charging orders and see what representation you can make to ask the court to dismiss the application.

              You have 18 days to request a set aside if you have grounds to
              Fees may be a good enough reason unless you have Agreed this fee or it is on your contract for rental. You need to get the form completed and get down to the court ASAP

                    So, I guess the question is 'Can Godebt apply for a charge on my house for their solicitor fees as well as the original debt?'. any ideas? How do I find out how much they are applying to put a charge on for?

                          Can you make a part payment to bring it below £750.00 ? If so, that's the best option as they cannot proceed if it's lkess than £750.00 but you may still have to pay legal costs incurred as well.
