Hi all I am new to this forum so I'm not sure if this is the right place to post but here goes...
So in July 2013 I was in Birmingham City Centre and I parked my car in a private car park (so I believe), the company is called Vehicle Control Services LTD. I went to the ticket machine only to be interrupted by a homeless person bugging me for money which was distracting me whilst I was putting my money in and I didn't realise I had to enter my registration number so I just placed my £2 in the machine and pushed for my ticket which it gave me (and I still have until this day!) and I placed it in my window and went about my day and I was back to my car before the 2 hours ended. I thought nothing else of it and went about my day.
Few weeks later I had a letter from VCS saying I had to pay a £100 fine, I obviously appealed against this decision and I explained about the homeless person and that I actually still have the ticket on me so I don't see how they could still want to fine me for something which I have paid for.
Some weeks later I got a letter saying my appeal was not successful and I would still have to pay the £100, I told them I would not be paying the fine and that was that.
Today I got a letter from Newlyn Debt Collectors Ltd with a heading "NOTICE OF APPOINTMENT AS DEBT COLLECTORS" claiming that I now owe £166.00 and if I don't pay then further action may be taken etc.
I phoned Newlyn up and told them (not very nicely) that I will not be paying the debt, the man on the phone replied to me saying "If you don't pay you will get a CCJ for up to 6 years I believe", I then replied stating I won't get a CCJ until you have took me to court and that's if you win, his reply was "that's fine because you'll lose anyway". He then got some abuse from me and the phone call ended with him saying "I will note that you are prepared to go to court", I told him that's fine and hung up.
I am not sure if ringing the debt collectors was the right thing to do, but I had to take my anger out on someone. I still can't believe after nearly a year they are still trying to chase me for a fine which is unjustified.
Do I have a strong case? Especially when I still hold the parking ticket?
Any advice on what to do next or what not do would be great.
