If anything, the directors of AW need to be held to account and their debt collection practices subjected to formal scrutiny. They'll like not a lot, but it is needed as Aw, along with Southern Water, are notorious for questionable debt collection practices.

Hopefully the MP will give them a kicking, but water utilities will ignore vulnerability until it smacks them in the gob.

Can you scan up what you have - after making sure all personal info and ref no's are hidden? Do you also have the Form 55 you should have been left?

It is high time the Attorney-General stopped faffing around and started doing what he is paid to do by the taxpayer and that is restricting the access to the justice system of those who abuse it. Both Anglian Water and Southern Water are repeat offenders and should be put on the Vexatious Litigants List as a matter of priority.

I'm getting lost as to what is happening as you appear to have 3 threads on the same subject. To make life easier I have asked for them all to be merged and will come back later on. It seems to me as if the solution is quite easy.

Some of what I am about to say may sound harsh but I am putting myself in the position of how a Judge may look at things.

You have a CCJ awarded against you for non payment of Water Rates that appears to date from 2008 - can you find out the exact date? If it does stem from 2008 and you have known about it you have since failed to do anything about it. To be able to claim Set Aside you may have had an opportunity on the basis of non-receipt but not this far down the line. However your other problem is your reasons for contesting it - even if you thought you were being overcharged you would still be expected to make payments rather than withhold it all.

Have you paid Water Rates since this CCJ was awarded?

For some reason AW appear to have left enforcement until the last minute it is for this reason I would like to see a copy of the Form 55 you have.

I won't make any further comment on the rights and wrongs of the alleged levy as there has been plenty said already.

As Marstons have a valit Writ of FiFa it is most important this is addressed first. You need to apply for a Stay of Execution which if granted halts any further action by the HCEO or further costs. This applied for on Form N244 and costs £80, if you are on certain Benefits or a low wage you may be able to apply to have the fees waived see Form EX160a & 160c for details. All Forms available from your local County Court if unable to download them from HMCTS website.

I note what you say about your family circumstances and you must make both Marstons & AW aware of this. You will need to provide some form of proof. Marstons do have a Welfare Dept. Both organisations are not clairvoyants and need to be told of your circumstances.

As for AW it may pay to also talk to them to see if they have some form of Water Charity that could be used to pay this in full or in part. Have a read of this http://www.anglianwater.co.uk/househ...ng/assistance/
