    Re: please help!

thanks for that! sounds dead good that does... I want to kill their pigs!!! lol the car in question while we are borrowing it is parked outside on the road.. so easy pickings for the bailiff to take.. but showing them a copy of the V5 is nice and quick.. Im hoping Jacobs will just retreat and not bother sending anyone though after my email lol *I can wish* as soon as I have a response from them tomorrow if they ask for proof I shall get hubby to talk to his boss - so this should be quick - just want to only do that if absolutely needed. The trailor tent however is not on road, or a drive... my house is detatched is situated in side a complete perimeter of fence/walls, there is one entry in a wooden gate (not locked) where anyone has to come through to come to my door, which makes them be in my whole garden if that makes sense.. the garden goes round my whole house (I always leave all my curtains shut when I am not in as all my windows are available for anyone that enters my gate, to look in. The trailor tent is on a raised concrete area inside my garden, and Im just wondering if they would bother trying to take it out? they would have to walk in my gate, then open some big old ramshackle gates that you have to hold when open so they don't fall down, and theres stuff like an old fridge/dishwasher and heavy stuff thats are all piled up behind it ready to go tip so they would have a lot of work to move all that then try and get gates open then they would have to try and manoveur it out which is not easy... Im just wondering if they do appear whilst I am trying to sort all this out, would they actually try and take it do you think? then theres just the bbq left which like I said is worth nothing compared to what I owe... what do you think? just wonder if Ive got to be worried if I go out through the week... I would probably come back to find out all my gates have collapsed and all sorts!! (but hopefully it may injure one of them!!!) ha

        Re: please help!

        its East staffs council.
The car has now been taken back to owner - I cant be doing with the hassle of if it got clamped/took away - if we need to borrow it we shall go pick it up from the owner ourselves. Its not immediately local so its not going to get seen by them anywhere - it says on inventory im breaking law or something if I remove any of the items listed, but Im not bothered about that seeing as they are not acting within the law by listing it to be seized in first place!
Hopefully I will get replies from Jacobs and the council at some point today and shall update when I hear anything :-)
        Thanks again to everyone!

Exactly so, they have no right to the carso you are not breaking the law imho by denyng them access to something they are not entitled to sieze

Jacobs would clamp or take it if it was still at or near your premises. They are good at doing that, I'm only amazed they haven't already been and clamped or removed it it, before you had the chance to take it back to its rightful owner

Get a lock for the gate and pit pricka strip along the top . It discourages undesirables and without a lock on your gate the insurance for garden furniture like barbeques may be invalid.

Can you get a toy car of the same model and change the number plates to match the one purportedly seized?

Then leave it on a window sill outside for when the bailiff starts asking where the motor car has gone...

                      True.

He'd probably pop it in his pocket, then charge a "van fee" for its removal.

                            Re: please help!

Hello! I just wanted to post an update on this and thank you for your help!
I managed to sort out some of this with a lovely lady at the council who put a hold on Jacobs I have nearly paid all my debt to the council now... just have one payment to go which I am paying on Friday - ive been skint while Ive been paying it off over 4 payments but I am glad its nearly over! I however still have the matter of £231 of Jacobs 'fees' Jacobs want me to pay and it appears they wont be giving up on them.
the council emailed me before saying that the bailiff called on the 1st, 4th and 7th of feb... the 7th was when he did the levy, but there is NO way he came on the 1st and 4th as I was in on both of those days - I had nothing put through the door and nobody knocked/rang bell so these 2 visits were made to either the wrong house or they were never made at all. Jacobs have emailed me to say my allegation that the bailiff did not visit are not acceptable as they have gps technology that shows where the baliffs go.
so! I was wondering if anyone knows what I can do to lower these fees... when as far as I am concerned the bailiff only came on the 7th of feb while we were out (and not on the 1st and 4th) and levied on a car that wasn't there, the trailor tent that isn't mine and a no good bbq... what are the fees I SHOULD pay as I will gladly pay for what I SHOULD pay for!
I would just like to know where I stand before I email them and make a fool of myself!

                            Thanks so much!

                              Re: please help!

I am currently recovering from chronic fatigue so I will keep this brief.

Civil enforcement companies often crow about having GPS co-ordinates to prove they made a visit. However, such co-ordinates can be easily-obtained from websites like Google Maps and Bing Maps. So any alleged GPS data they claim to have is open to challenge.

You could write back to them about this particular point along the following lines -

"You claim your company has GPS data which it alleges proves the bailiff [Name of Bailiff] visited my home on [dates]. As I am sure you will be aware, such data can be easily-obtained from internet websites, such as Google Maps and Bing Maps.

Under the circumstances and in the absence of any credible and substantial evidence proving the veracity of the statement that the alleged visits were made to my home, the visits and attendant fees remain open to challenge."

My suspicion is that if Jacobs were put to strict proof as regards the visits, their ability to substantiate the visits would be wanting.
Life is a journey on which we all travel, sometimes together, but never alone.

Use of GPS technology is neither here nor there, it doesn't prove he knocked on your door and the suspicion is that if no notice was left he just drove by instead therefore putting himself in the vicinty.
