Thank you for that, Sir Vere. From what the gov.uk spiel is saying, the court did have the option of imposing a community sentence instead of a fine. It also raises questions as to whether or not the Justices and Justice's Clerk followed correct procedures. It also raises further questions as to whether the matter needs to be referred up to HMCTS headquarters. I do know that there is disquiet as to what is going on where HMCTS Kent, Surrey and Sussex is concerned. They seem to be singing from a completely different hymn sheet to the rest of England and Wales.
I have, in the recent past, assisted a person to lodge a formal complaint against HMCTS Kent, Surrey and Sussex over the behaviour of a Justice's Clerk and two Justices. It involves Council Tax, but the matter has "Unlawful from the Outset" written all over it.
