Re: Can they do this ???

They didn't try to clamp hearse but were after entry to the property to levy. Apparently they were taken into the front room where the coffin was and allowed to see the named debtor was indeed dead.

Lol! It certainly did, Charity. My cousin is over six feet tall and built like the proverbial brick outhouse. The salesman did leave rather quickly when my cousin made his offer to him.

Did they not want to take the deceased blood that was all that was left?

I can imagine the funeral director showing them the deceased in their coffin and then saying to the bailiffs, "I can do you a very nice one in elm. Now, if you'd like to stand still, I'll just measure you up." I reckon the bailiffs couldn't have left fast enough.

Now that would look just great on YouTube, especially if the bailiffs named the company they worked for on camera...

Re: Can Bailiffs take deceased mans car?

All assets are frozen on death. Only the executor may dispose of assets. If someone says they have a claim on the estate, they have to submit that claim to the executor - they may not help themselves.

Make a formal complaint against the policewoman. They will try to duck and dive, but don't let them put you off. This is so appalling that it needs to be pressed to the bitter end.

You could also see if the local paper is interested. A headline along the lines of "Police stand by as bailiffs step over corpse to loot house", would certainly provide the Chief Constable with a little impetus.

Seems like a good plan to me, the fact is as you stated at death everything goes through the executor, so the bailiff and police officer could be in rather hot water.

Re: Can Bailiffs take deceased mans car?

I have a feeling the Chief Constable will want to wring the policewoman's neck, along with that of her shift inspector and station superintendent - after the Coroner has threatened to ritually disembowel them.

What Enquirer says in Post #21 is spot-on. Anything in a deceased person's possession at the time of their death is subject to the requirements of Probate Law, which means anyone having a claim on the estate, including anything on HP or other finance, is on hold until the executors have administered the estate.

As for what this bailiff did, if the Chief Constable wants to avoid some very unwelcome adverse publicity, he would do well to have the vehicle seized. Certainly, if there are any doubts as to whether the death is anything other than natural causes, this would be a wise course of action to take.

Speaking from personal experience, some muppet from an alarm company knocked on my door on the day of my late father's funeral, as we were waiting for the funeral car to arrive, trying to push his company's wares. Despite requests for him to leave, he persisted and would not leave. In the end, one of my cousins came out and offered to remove the salesman with the toe of his boot. The salesman finally got the message and left.
Fortunately I have never suffered such an experience with Ballifffs but the Threat Monkeys at Leeds Losers ran a close second when they rang me many moons back. I was waiting news from a hospital regarding a life threatening illness my wife had and they refused to get off the phone until I agreed payment terms with them. I was distraught and the C**t was laughing. However I had the last laugh. My wife got the all clear and Lowells drove me to google. The rest as they say is now history and they have probably saved me over £50,000

Pity you didn't let the media know, ODC. That sort of thing gets a lot of people's backs up. What tends to happen is people will ring up and give them a load of abuse. They eventually get so p*ssed-off with it, they end up turning on the muppet responsible. Works most times.

Unfortunately in those days I was not as wise as I am now. Nowadays I am the one laughing at the Leeds Losers

I expect you had other thoughts on your mind at the time, or you'd have nicked that box-wallah for attempting to prevent a lawful burial?

I was very tempted to tell him to stick his alarms where the sun don't shine, but my cousin came out and offered to remove him with the toe of his boot. When you're faced with someone over six feet tall and built like a brick outhouse saying you that, you don't hang around. The alarm(ed) guy was gone very quickly.
