Advice on Bailiff Fees from Jacobs please

    Many thanks for your help and advice Sir Vere Brayne d'Emmidge.

    In response to my letter in November to the Council, Jacobs suddenly sent a letter with amended amount due which took off all the fees!!! Funny that!

    We heard nothing from them since then until today. Another hand delivered 24 hour removal demand from Jacobs with a different bailiff's name on this one. Confused as they have been told on many occasions that there is nothing at the property that belongs to my brother. He has continued to pay the council every week. If Jacobs turn up tomorrow I have proof of car registrations and a stat dec saying everything in the property belongs to me.

    We really want this debt handed back to the council but seems they are adamant it will stay with Jacobs. We have repeatedly asked the council for their complaints procedure and details of payments made and amounts due but they have ignored our requests and sent nothing.

    Please can anyone advise on what we can do next to try and get this debt back to the council? Thanks in advance and Happy New Year!

      you have no legal requirement to deal with bailiffs . Just pay weekly via the councils on line payment system .

        Show the muppet oops sorry bailiff the Stat Dec, inform the bailiff that subsequent visits will be classed and logged as harassment, contrary to the Protection from Harassment Act 1997 inform him the named debtor is paying the council direct, he has no business with you, and if he persists call the police, and show them the stat dec if the Jacobs biscuit is still there when plod turns up, once he has had sight of the Stat Dec ask the police to remove him

          If your brother was a sole trader or partner in an unincorporated partnership, when in business, the Human Rights Act 1998 may well apply in that the council, being a public authority, must deal with any affairs pertaining to your brother in a timely fashion and not mess him about, which includes withholding documents, etc.. Incidentally, Jacobs are subject to the HRA where they are carrying out functions on behalf of a public authority. If your brother was a director of a limited company, as Sir Vere has alluded, the council and Jacobs are stuffed. Likewise, if you brother has been formally declared bankrupt and is subject to supervision by the Office of the Official Receiver, it is likely the council and Jacobs are stuffed.

          As regards the letter you suddenly received from Jacobs, withdrawing a load of fees, it is possible that the council gave them an earful or realised Jacobs had exposed them to potential litigation and told them, in no uncertain terms, to stop playing silly buggers. If this is the case, then the council should be commended for doing what they are supposed to do and that is keep their contracted enforcement agents on a short leash.
