  • Marstons and Liverpool city Council

    Morning boys and girls, bear with me i am a 1st poster.

    Many years ago my current partner got behind with her council tax payments (thanks to her gambling ex husband) as soon as she found out about it she contacted the council and sorted it out, or so she thought, a deal was agreed over the phone and she has paid £200 per month for the best part of 5 years.
    A couple of months ago we had a Marstons bailiff visit, i met her at the gate as i was outside, she prattled on about 7 years of debt, i said that the debts were being paid every month and that my better half was not in and she needed to speak to L/Pool council, off she trots.
    Jules then goes to a L/Pool legal group on the advice of her solicitor cousin, she tells them everything and a subject access request goes to the council, also Jules checks her bank and can prove every payment.
    23/7/13 she (Marstons bailiff) comes to the door, attractive blonde lady, easy to remember, i answered, again she says 11 years owing (she also said 5 and 7 years) i repeated that it was being dealt with by the legal people and the council.
    I then asked for a look at the liability or court order, 'we do not have to carry them and keep them at the office' i laughed and said she was such a liar and could i have that in writing, she said i was now being deliberately evasive and she had no choice but to call the police, i said i would wait in the garden with her while she did, strange she got in her car and drove away.
    Reported all this to Jules when she came in from work, Wednesday she went into the legal place and found out that the council had sent a load of rubbish and nothing asked for, this had not been dealt with as the man dealing with it was on long term sick, a new lady is now dealing with it.
    We have sent recorded a letter to Marstons and one to the council saying we will only deal with the council, a new subject access has been sent, a complaint has been sent to the information commissioner and an email has been sent to our MP, shockingly he replied within an hour, he has sent a request to the financial director at the council asking for answers.
    Jules has spoken to the council and they admit that there system shows no current problems and they have made no attempt to contact us, i have emailed Marstons asking for a written confirmation of their staffs lies, hmmm, no reply.
    Turns out Liverpool council do this a lot, they take the payment and use it ALL (never agreed to) to repay the debt, we were under the impression that £120 was being paid for council tax and £80 going of the debt every month, they have been taken to court over it and lost and they will be able to provide nothing to say Jules agreed to that ridiculous plan.
    We are hard working pay our debts people and are not in any way shape or form going to be intimidated by lying bailiffs or 'do as we tell you' councils....the fight has now become personal and we are now smashing the ball into their court.
    I am expecting Marstons as soon as they receive the letter from the council taking back the order, i have read all there is to know on here and other forums in dealing with them, i am really looking forward to seeing them again..

    Just to confirm, can i throw pepper in their face...???
    I assume they will now send the 'big boy' in not the lying lady again

      I have 3 cars on the drive and outside, all are in my name which is not on their records, we also have a very good camera and recording system watching all access areas to the house and a 3 min response time from the police if called (Jules had a few problems in the past with the national front, she had published a few scathing articles about them we also have fire proof fences and a bomb catcher on the back of the mail box..lol, also there is a side fence of 10' with police approved spikes and some disgusting black goo on top and then the 14' wall around)

        Can't see the point in re-submitting a SAR as only one is needed and if they have mucked that up then serving another will do nothing except repeat the same again. If a SAR has failed then you need to point out what is missing from it. Better bet is to give them a list of questions and see what you get back. You need to speak to someone at the Council and ask the following questions:
        1 - how many Liability Orders they have against you
        2 - the dates they were obtained
        3 - the addresses they were for
        4 - the period of time each covers
        5 - how much each one was for
        6 - how much is still outstanding
        7 - the dates they were passed on for enforcement
        8 - the dates & amounts of any payments

        You need to ensure that each one is only for a period of time that included her & the ex, if there is a recent one from a time when you have been resident then the car(s) are fair game.

            Is the moat stocked with piranha or crocodiles?

              No, Tiger Lily the worlds most vicious cat ripped them to shreds...having read what i typed as a bystander it does sound like some kind of fortress, just a 2 bed semi in Toxteth..

                    As regards throwing pepper in the bailiff's face, in what circumstances? There are circumstances when it is lawful to do so.

                      If you are in immideiate fear of life or safety, with a bailiff physically assaulting a debtor or third party it would be a reasonable action imho, but Marstons would cry wolf and get debtor arrested, relying on uneducated in bailiff law plod to do his bidding that is why I advised caution BB.

                        Absolutely, BB.

                        As regards the use of pepper against an assailant or intruder, I checked with Devon & Cornwall Police some while back and as far as they are concerned, if someone is trying to gain unauthorised or unlawful entry to your property and is resisting the order to leave or uses force or is trying to attack you, then the use of chilli or cayenne pepper is legitimate. The police use a concentrated form (2 million on the Schofield Scale). Police forces were forced to change over to pepper spray after a police officer suffered permanent damage to their lungs after accidentally inhaling CS spray, which is known to cause permanent damage to the eyes and lungs. It is also banned under various international treaties and conventions.
