Absolutely right Leclerc - if you look at the final bit of post 6 I've said I'll ask them to scan the ticket and send it to me so that it is clear what sort of ticket it is. In this case, it is not as simple as asking them over the phone unfortunately.

The Road Traffic Act quoted in the link you provided is what allows these contraventions to be non-criminal.

Hi casper I found this site very very helpful when I got a ticket which involved the court but later I won and did nothave to pay.........don't know if someone already has posted it but for future it is a very good forum with some very good advice from many.

What's the plan for dealing with the bailiffs and Council Tax? Might be useful for others in the same/similar situation to follow.

I can't answer that just yet as the person concerned gets very muddled and at the moment we're still in the process of clarifying things regarding the magistrates' court fine as clearly this is a priority.

There is the obvious issue of overcharging on the CT side of things, this apparently is for a visit to levy, but as no levy took place it should obviously be the normal first visit charge. I think the main problem here is the apparent unwillingness of the bailiffs to accept a reasonable offer. She'll be writing to the Head of Revenues pointing out the overcharging and the council's vicarious liability with their appointed agents, their refusal to enter into a repayment plan and it will be interesting to see the reply to that letter.

The magistrates court fine, if it is a magistrates court fine, which hasn't been clarified yet, is indeed a priority, but then again so is council tax. Is she up to date with the current year's council tax?
If the fine turns out to be civil not criminal, then priorities will have to be revisited, I would think. Whilst it's not an offence to be unable to pay, the council tax will have to be paid in the end. A SAR to the bailiffs would be in order, as well as a letter of complaint regarding their overcharges.

If she has proof of the £120 charges (and I know as things are it's an if so not ideal), then I can see no reason to SAR them. A letter of complaint will be being sent to the council as mentioned complaining about the charges and their appointed agents refusal to accept installments. It's very difficult until we hear back to post anything more definitive for people to help on.

If she has proof of the charges she still needs to complain to the bailiffs themselves, not just the council, copying both parties into each letter. Once the bailiffs realise they have been "grassed up" to the council, this generally tends to result in a (downwards) review of the charges.

Hi everyone. I have just had a call from the police saying that my parked car had caused an accident. It was parked fifty feet from the nearest junction on a straight part of the road with no markings on it. The policeman stated that he can either give me a warning over the phone or visit me with a £60 fine and points (my choice). He then said that I could park there but not at busy times. Surly it's the fault of the other drivers and not my car.
Anyone else had the same problem.
