Can anyone help out.
First thing this morning as I was about to drive into work, I noticed my car had been clamped on my driveway with a notice stuck on the passenger window stating that the vehicle had been demobilised by JBW Group Bailiffs and that I had 24 hours to settle money owing.
Initially I thought is was a wind up as this was the first time I heard of them or had any correspondence from them. There was a mobile contact number which I phoned - the bailiff then arrived at my property around 7:30am and informed me that the action was taken due to an unpaid parking fine for Bexley County.
The parking fine was for £155.00, I had already written to Bexley Council informing them that I will be paying the fine in three instalments - as that was the only way I could afford to pay it. They had received and accepted the first payment end of February, the second payment was received and accepted end of April. The third payment was scheduled for end of this month - I decided to pay it online that morning - in order to clear the balance completely.
The JBW Bailiff then demanded I pay him £525, to release my car. I explained to him that the account had been settled and that an agreement had been in place to pay the fine in instalments. Just before 9:00am the bailiff then handed me a note indicating that the charges had gone up to £757 and that if I do not agree to pay it they will tow the car.
I tried getting in touch with the council but was unable to get through - the bailiffs then towed the car away a few minutes before 10:00am. About ten minutes later I was able to get through to Bexley Council parking services who confirmed that the account had been settled in full by me and that they have informed the bailiffs. They advised that I take the issue up with the bailiffs as from their perspective I had settled the account.
My car is worth well over £7,000. JBW Group verbally told me that it will be auctioned off in 7 days unless I pay whatever amount they decide to quote.
What do I do - as I feel my rights have been completely trampled on. At the time of their visit to immobilise my car - the outstanding amount was less than £50. What right do they have to seize my car for this - especially when I paid it in full before the car was taken away?
Any help will be well appreciated. The car is used for work. I told them this and as a direct result I can no longer work. So this is causing me further hardship.
