  • How to create a Settlement request letter

    Hi guys, I have had letters sent from Cohen Craven Solictors acting on behalf of Lowell, the original creditor. I sent all the original cca and requesting information, credit agreement etc. This took about 5 months to arrive. I’m not disputing the claim as I’m now willing to pay it.

    They would rather come to an agreement instead of going through the courts. I did post this in my original post but I don’t know if it’s active anymore as it’s over 6 months old and I hadn’t heard back from anyone for near on a week. I was just getting worried as they sent me a letter with 30 days to response and I’ve got about 12 days remaining to send a settlement request claim offer to them. I would rather send them this via a letter as I don’t feel confident enough to speak to them over the phone.

    would someone be able to help me creating a template or a letter for full settlement claim with both options of installments or in full. This is all new to me so I’m unsure how I go about doing this letter and I don’t want to get to last few days, especially as it will take a good two days to arrive.

      Thank you. i will do tomorrow. I was just worried as I hadn't heard back from anyone in my original post and I was getting worried as I have to respond to the letter they sent by the 5th of june 2018, or they will apply for a ccj and court action.

        Okay, so the main thing to note is that you don't admit anything and all letters/emails need to have "Without Prejudice" as a heading.

        You need to remember that Lowell have paid about 1p in the £1 for this dept (£1 per £100) and therefore make them an offer of 30% of the debt, they'll probably work you up to around the 50% mark in negotiations. Only pay the full amount if they refuse to budge.

        In requesting the settlement ask them to confirm in writing that the figure is acceptable, represents "Full and Final Settlement" of the matter and how the payment should be made.

        Only once you have all that confirmed do you make a payment.

              Thank you for your help. I won’t admit to anything. There other debts are owe have now came through from Lowell but I will ignore them as I believe the 50% offer they made on those two are just a way to get me to reply but I will deal with those if they ever send me a letter before action and hope that I can get close to the 6 year mark but I’m over two years I think to achieving that, so I will deal with those when that time comes.

              i will proceed with getting this letter out without admitting anything and I will send recorded delivery, next day post signed for. Is 30% you feel the lowest I should offer?

                Thank you Rob, I’ve seen your post you posted in the main thread, so I will respond in there now but it seem so Lowell have got two of my bigger debts but they are offer letters which I will not respond to until I have a letter of before action, so I will deal with those at the time when that comes to that. I won’t admit to owing the debt which I’ve never done as I’m trying to delay this as much as possible in the hope to get to the 6 year mark but I’ve got s good 18 months or so to go. Is there a way I can find when my debts would hit the 6 year mark?

                How much do you feel I should offer them? 25/30% of the original debt?
