  • Paying Back Apprenticeship Fees

    Hi,

    So I'm doing an AAT Level 3 apprenticeship (I was 19 when I started). However due to moving house I have to resign (still in my probation period). In my contract it says I have to repay fees, but does this apply in the probabtion period? Also, do you have any idea if this is a government apprenticeship and if they get paid for having me (and how much?)

    Here's a copy of the training contract terms:

    "Repayment of Training Costs
    12. You may be required to repay all the training costs and any associated costs incurred by the Employer in connection with your AAT training course in the following circumstances:
    (a) your employment terminates, for whatever reason before the completion, or within twelve months of the completion, of the AAT qualification. The training continues until you have successfully completed all examinations, practical training and have received official confirmation of your qualification. You must provide a copy of this certificate to the HR Manager
    (b) you abandon the training without reasonable cause
    (c) the Employer believes, in its entire discretion, that you are not diligently pursuing your
    studies
    (d) if you fail all or part of an examination at the second attempt
    If you are unable to continue your current role due to long term ill health during the training, the Employer will not require you to repay the training costs.
    The Employer may deduct any sum due from you under this contract from any sums payable to you by the Employer, including salary. If no such sums are payable to you, or they are insufficient to meet the training costs, you will repay the balance to the Employer within a maximum of 3 months of the termination of your employment. You will be notified of the amount of the deduction(s) and when it/they will be made.
    Training costs will cover the following (where applicable):
     Course fees
     Mandatory books and course materials
     Exam entry fees
     Revision courses
     Annual subscription to the AAT
     Travel/hotel/subsistence costs"

      Hi [MENTION=94709]annaelephant[/MENTION] and welcome to the forum. I am not an expert in apprenticeships but I will try and help however I do have a few questions to ask,

      When you mention being in your probationary period does this mean that you have only been with the company for a short period of time and you were hired directly by them into an apprenticeship scheme. Or have you been with your company for a while and they have put you into an apprenticeship scheme and you are in your probationary period for that?

      How long is your probationary period?

      Who is the training provider that your employer has set the scheme up with?

      The clause you have detailed I presume is part of an Apprenticeship Contract, or an Apprenticeship Agreement which you have signed?

      If you can answer the above it will give me more information upon which I can hopefully provide some guidance

        Yes, I've only been with the company for 4 months, the probation was three months and then they extended it for another month because my dad died so I was off work for a bit.

        The training provider is the local college, and they work using a framework from the AAT (accountancy).

        The contract is their "training" contract which I signed in addition to my employment contract.

            Thanks [MENTION=94709]annaelephant[/MENTION] for the answers to my queries and so sorry to hear about your Dad.

            Firstly I suspect that the company may have already made some payments in connection with your training if you have started this even though you are in your probationary period. Unfortunately the clause in the contract is very clear as to what the repayment position is. On a practical level it may be worth speaking to the college first and seeing if you could suspend the course whilst you move, get settled and find another job and then maybe take the course back up at a later date? If this is a possibility then it may be something that you can go back to your current employer with as the basis for discussing what any repayment terms.
