I’ve lodged a complaint with the Ombudsman against HSBC (First Direct) for indirect age discrimination in respect of their declining to extend my mortgage on the ground that I am a pensioner with a SIPP. I await to hear further.
In 2011 I applied to First Direct for, and was granted, an interest-only set-off residential mortgage. I had applied for a term expiring 2022 but that aspect was refused on the basis of my age. I was forced to accept a shorter term, expiring 19 June 2017.
From media reports I later became aware that formal age limits for mortgage applicants were established as discriminatory. In April, looking ahead to expiry of the term, I applied for an extension of the term for a further 10 years from 2017. That application was refused without proper enquiry into my financial circumstances, and I was refused access to the bank’s assessment criteria.
I live on an index-linked final salary pension. I also have a SIPP which is capable of being liquidated at any time. My total worth is capable of servicing, and repaying, the mortgage.
In my complaint I have said that the 2016 refusal was indirectly discriminatory on the grounds of my age. At the date of the application I was aged 64 and retired, as are many people of my age. Additionally many people my age have private pensions. I have said that to refuse my application on the grounds of my being a pensioner, and the possibility of a pension being involved to repay a mortgage, is indirectly discriminatory on the grounds of age.
Can anyone help me with any accessible law on the SIPP/indirect age discrimination point please?
