  • Ccj does not belong to me!

    To Whom can help!

    I have a CCJ on my credit report that does not belong to me. The CCJ relates to an account with EE (Telecommunications) and is linked to Bideford, Devon. I have never lived in Bideford or had any dealings with EE.
    I have been in contact with the Credit Reference agency and they advised me to contact Northampton bulk court directly. I did so and Northampton Court sent me the forms to get the CCJ set aside. I still haven't done this part as they require me to make a payment of £155.00 of which I find very unfair. The CCJ doesn't belong to me but yet I have to pay to get it sorted? And! If I do pay the £155.00, will I get it back!? and what happens after?

    Not really sure why or how it ended up on my credit file but really want to get the issue sorted


    Your help would be greatly appreciated as this is extremely frustrating!

          Hi Daniel,

          the CCJ presumably has your name on it. What is the address used, is this one that you have ever lived at?

          It's not clear to me at the moment if they (is this EE? or a debt collector?) have sued you and got a CCJ - in which case you need it set aside. Or if they sued someone else and it has got incorrectly linked to you on your credit files, in which case you don't want a set aside, you want to get the credit file link removed.

            The CCJ has my name on it yes. The address used is 22 Harlseywood, Bideford, Devon, EX39 3FB, and no, I have never lived here or had any connection with this address.

            I was thinking about sending a letter to EE to ask them to remove the CCJ but no sure if this would work.

            I friend of mine advised that if i pay the court to have the CCJ put a side that there's a chance it will come back! which I obviously don't want!

            Only problem is, I don't know where to start if I do contact EE and who do I send the letter to? what are my rights?

              Hello Dan,

              Is the judgement in the name of EE?

              When was the judgement given?

              I should be relatively easy to get the claimant in this case to set the judgement aside.

              Please give us some more details on the judgement. the date/ amount etc.

              I can draft a letter for you if you want to get this sorted quickly.

                Thank you so much for your reply.

                When I phoned the Court, they told me that the Judgement was in the name of EE yes.

                I actually noticed this Judgement two years ago when I applied to rent a flat which was successful, I tried getting the Judgement removed then but didn't really know where to go or how and have finally decided to do something about it!

                The date of the judgement is 17/12/2012 & the amount is £493.00, linked to the address previously given and Northampton court.

                I've sorted of started a letter but thought I'd ask you guys as I'm sure you're experts with this!

                Appreciate your help.

                  OK then it seems likely that there is nothing wrong with the CCJ and so there is no reason for you to pay to have it set aside. The problem is that the CCJ and this address has been incorrectly linked to your account.

                  I suggest you:

                  a) put in a formal complaint by letter to EE http://ee.co.uk/help/safety-and-secu...de-of-practice. This should state clearly that you have never lived at the address on the CCJ and that EE have incorrectly linked this CCJ with yourself. If you have ever been an EE customer, give the addresses that you have lived at and your EE account number(s) so they can see who you actually are. If you have never been an EE customer, say this and say which mobile network provider you do use.. Ask them to delete the CCJ and the wrong address from your credit file.

                  b) complain to every CRA that this CCJ is showing on. For Experian phone the number under "There is a linked address on my credit record I do not recognise" here https://help.creditexpert.co.uk/help...nked_addresses

                        I thought so too but if you move it will follow you.

                        When end you look at your credit file is the address in Devon linked to you. Maybe a bit of detective work with the electoral role could help your case.

                            Really appreciate your help.

                            I'm going to be sending out the letter to EE today via recorded delivery and will also send 3 separate letters to the credit reference agencies.

                            Will keep you all in the loop with what happens.
