    Hi i have just joined the forum hello to all, hope i might be able to get some advice on lowell-shop direct, last paid 2008-2009, lowell aquired in 2009, threatend with court action sent a cca request in april 2013 told them that the account is in dispute, still waiting for cca request never came, recieved a letter from on the 29th july 15, a pic is attached they said i have a ccj with them checked my credit file it is not on there, so not sure how to reply to them, any info would be greatly appreciated, thankyou

    Somehow that doesn't sound right, the letter is signed by someone who is a PRE-LEGAL Operations Manager. :mmph: And if they really have a CCJ, how come they are offering a 50% discount?

    Have you recently moved so they could have issued a claim to an old address?

    If the judgment is recent, it may not yet show on your credit file. You can search the registry of judgments for a small fee: http://www.trustonline.org.uk/search-yourself

    If you don't find anything on the registry of judgments, I would be inclined to ask them for a copy of the alleged judgment. :typing:
    It could well be a ruse to get you to acknowledge the debt if it's not yet SBd, :scared: if it was, it wouldn't make any difference as once SBd it cannot be 'un-barred' even by making a payment. If this really is Lowell's new trick and there is no judgment, it's one that should definitely be reported to the FCA.

      Hi thanks for your reply,
      No been same address for 15yrs, the last time i heard from them was the 3rd may 2013, i have never recieved any court papers or any other letters from them since, it defaulted and the last payment was in mid 2008 it was signed over to lowells they said on the 7th april 2009, the account was opened around 1999 early 2001. i will get on to it straight away and find out if there is a ccj thankyou very much..

        :bounce:Thanks FlamingParrot for that info, checked the site you recommended and it says nothing registered, so i wonder what they are playing at :noidea: i dont have any claim or ccj against me, just wondered now what should i reply to their letter, like you said ask them for a copy of the alleged judgment maybe...

          I think asking them for a copy of the judgment, or at least the claim number, would be a good idea, I would also reiterate that they continue to be in default of your CCA request. Unless that judgment was awarded within the last 28 days it would show on your credit file, which is unlikely - who offers a 50% reduction within a couple weeks of getting a court order for the full sum ? It seems to be a lie.... possibly a way to make you contact them.... so in your letter to them tell them you do not acknowledge any debt to them.

          If there does turn out to be NO CCJ, then you should report the letter to the FCA.

              Hi all, sent a letter to them and there head office on the 10th aug and guess what the letters have not been signed for, still waiting for them to be delivered and signed for so no reply from them as of yet... :noidea: just wondered if i should send some new letters and just post them with a stamp ? they obviously dont want to sign for any letters anymore..

                Quite often (I find) RM do not update their site to show the letters have been delivered as soon as it's happened ... give it a day or two more and them maybe contact RM to see if they've delivered it
                Debt is like any other trap, easy enough to get into, but hard enough to get out of.

                  Same here, in fact I have, on occasion, received replies to letters that never showed up as received. The RM site doesn't work 100%.

                    Trouble mostly if sent to a Post Office Box number as signed in bulk, so make sure actual address for delivery, many a time had same problem but always had a response stating reference your letter of etc

                        From what I can see above it's been two weeks since you received that letter. Have you by any chance checked the CCJ records (trustonline, not your credit file) again to see if something has been recorded? I would be tempted to check again! :typing:

                          Hi checked the trustonline site as well as my credit file on the 7th Aug there is nothing on there its says no defaults or ccj's recorded. Yes I will double check again just in case thanks FlamingParrot....

                            ...and I assume you've got neither a response to your letter nor a general order of judgment from the court... I think I can smell a rat... :mmph: :ohwell:

                              Hi yeah no i haven't received a response from my letter i sent nor have i received a judgement order from the court.. i don't know what they are playing at....
