Email sent to Cabot, got an automatic response I’ll follow it up if I don’t get something back from them in a few days.
Letters to New Day, Cabot and Mortimer Clarke ready to post tomorrow.
I was going to send them signed for but Mortimer Clarke is a
PO Box Number, does that matter?

So I called Cabot today, I was told that since Mortimer Clarke were now handling the case, my email requesting more time, had been passed onto them (who also hadn’t bothered to respond to it!) she transferred me to Mortimer Clarke, where the woman I spoke to told me that the case was to be reviewed on Tuesday (13/10) and had I not contacted them today I would have got a CCJ on that day as the time had run out? She said she’d extend the time till 31st October, I asked if that was in response to the CPR15.5 she replied ‘CPR15.5?’ and didn’t commit further… I asked her to send email confirmation, she said she was unable to do that but one of her colleagues would, it hasn’t arrived.
For reference the date of the claim was 23.09.24 I thought having said I was going to defend the claim it gave me another 14 days which would take me to 21st October and not 13th as she said.
Im not sure I’ve handled this correctly but I felt I put on the spot
On a better note New Day have confirmed receipt of my request and are dealing with it.

In post No.7 you've put 'Issue date 24/09/2024'.
From the Issue that's the 24/09/24 you have 14 days to file your Defence.
You've acknowledged service of the claim, that gives you an extra 14 days, so that 28 days in total (plus 5 days postal).
The CPR 15.5 request more time on top of the 28 days.
If you get no email by the 18th October, just update the thread.

Hi, received a letter containing the following from MCS today…
Dear Ferdi
Thank you for your letter dated 05/10/2024.
We acknowledge your request for documents pursuant to Section 77/78/79 of the Consumer Credit Act 1974.
For the avoidance of doubt, this firm acts on its client's instructions. This firm does not hold the documentation you have requested. We have asked our client to provide them and will come back to you as soon as we can.
In the meantime, the matter has been placed on hold and no further action will be taken.
